Real estate boss sues Kmart and Westfield after she slipped on a wet puppy pee pad and injured her ankle

The owner of a property management agency is suing Westfield and Kmart after she slipped on a wet puppy pad and broke parts of her foot and ankle.

Brooke Joan Willis, 34, slipped on the puppy pad, which is used to potty train dogs, as she left the store in Brisbane's Cairndale on February 26, 2022.

The fall occurred during a flood in Brisbane and the path had been set by Kmart staff to accommodate a leak from the ceiling. Ms. Willis is now suing for $205,000.

In her claim filed in Brisbane District Court last Monday, Ms Willis claimed the fall left her in 'significant pain, suffering and mental anguish' and 'permanent partial disability'. Courier mail reported.

Ms Willis said the fall left her with a broken metatarsal bone – a bone in the forefoot – and a tear or break in the cartilage covering her ankle bones.

The 34-year-old, who was pregnant at the time, claimed she was unable to walk for two weeks.

She now also claims that she has difficulty wearing high heels, experiences occasional swelling and pain, and is unable to stand, walk or run for long periods of time.

Ms Willis said she will also likely need surgery on her ankle.

The lawsuit has been filed against Kmart Australia Limited and Scentre Shopping Center Management (Qld) Pty Ltd.

Ms Willis owns the company Brooke Willis Property which she launched in August 2020, and has also worked at Ray White and AUMR Property Management Group.

She claims there may be future economic losses as a result of her injuries, as well as additional costs for hiring additional staff.

A defense has yet to be filed, while no date has yet been set for the next hearing.
