Defamation case: Delhi court stays proceedings against Delhi CM Atishi, next hearing on December 2 | India News – Times of India

The Rouse Avenue sessions court has listed the matter for hearing on December 2, ANI News Agency reported.
Delhi CM Atishi had approached the sessions court against an order of a magisterial court that had summoned her in a writ petition criminal defamation case filed by BJP spokesperson Praveen Shankar Kapoor.
In the defamation case, Kapoor alleged that Atishi’s accusations damaged his and his party’s reputation. A Delhi court issued a summons to Atishi on May 28, which she challenged in court the following month. Subsequently, Atishi was granted bail on July 23 following her physical appearance and submission of a bond.
In her legal filing, Atishi argued that Kapoor failed to provide even prima facie evidence that the alleged statements were directed at him personally or were in any way directed against him. The Delhi Chief Minister noted that there is no explanation as to why the BJP itself had not lodged a complaint.
The Prime Minister also pointed out that records show that Kapoor was not a “person aggrieved” by the alleged offence, and therefore had no authority to file the complaint that led to her summons. The petition emphasized that the court could only hear cases of defamation if complaints came from persons directly affected by the alleged criminal act.
On April 29 this year, Kapoor sought legal intervention, stating that AAP and its leaders had leveled allegations against BJP following CBI and ED probes into the halted alcohol excise policy in Delhi.

According to Kapoor’s allegations, Atishi and Kejriwal alleged through media interactions and social platforms that the BJP was trying to destabilize the AAP government in Delhi by approaching 21 AAP MLAs, offering them Rs 25 crores each to defect to the BJP.
Kapoor alleged that these defamatory statements by the two AAP politicians, aimed at gaining political advantage through social media, have damaged his standing among the general public.
