ED will sensitize counselor after episode of 'offensive behavior'
NEW DELHI: After a Delhi High Court The Special Director of the Enforcement Directorate (ED) was summoned after a counsel for the investigating agency addressed the judge in an insulting and derogatory manner. ED assured the court on Monday that the counsels would be “sensitised” through a special programme.
Special Judge Jitendra Singh of Rouse Avenue Courts took note of the comments of the Deputy Director of ED and issued notice to Special Public Prosecutor Manish Jain, counsel of the Central Investigation Agency.
The court had summoned the official on Saturday after ED’s counsel was questioned about the reason for seeking adjournment in a matter related to the case. money laundering case involving Karnataka’s Deputy Chief Minister DK Shivakumar and others, reportedly spoke to the judge in a “loud tone” and simply said that he had been “ordered by the higher-ups” to do so.
The court directed the Special Director of ED to be physically present and verify whether the counsel had acted and conducted the case as per the agency’s instructions. This was necessary to take appropriate action to uphold the dignity of the court, the court added.
The ED counsel had sought adjournment after one of the accused, Anjaneya Hanumanthaiah, filed an application seeking release of the seized loose sheets and digital devices. The applicant said that since the ECIR (ED FIR) against him had already been quashed by the Supreme Court in March, it was the duty of the investigating agency to declassify the articles in question.
The court noted on Monday that the department had informed its counsel by email that they had no objection to the present application, and that 15 days’ time could be requested to return the seized items. The court asked Jain to inform the court why he had not communicated that the application had been granted by the agency.
