A bench of Justices Surya Kant and Ujjal Bhuyan took note of a dozen criminal cases filed against a person seeking anticipatory bail alleging that all these cases were related to various land disputes and police were harassing him and his family members. Senior advocate Rana Mukherjee, appearing on behalf of the UP government, told the court that on one hand the accused had not participated in the investigation while on the other hand he sought protection from arrest.
The court said that though SC has protected him from arrest, he seemed to be afraid that the moment he appeared before the police, he would be arrested in a new case filed against him.
“The UP police are entering a dangerous area. You register criminal cases in purely civil disputes. Tell your DGP that if this practice is not stopped immediately, we will pass such drastic orders, which he will remember for the rest of his life,” the bench said. , expressing displeasure. Mukherjee said if the police did not pay heed to the court, he would send the case back to the government. The court said the comments were aimed at the conduct of the police and told Mukherjee to use his good offices to drive home SC’s message.
The court asked the UP police to send the summons to the accused on his mobile phone, mentioning the date, time and place where he had to appear before the investigating officer. “The petitioner shall not be taken into custody in the cases registered against him or in any fresh case without prior permission of SC,” the report said.
