The nurse engaged in an employment tribunal about a trans -doctor using female changing rooms accuses a second NHS FIFE doctor or victimization and intimidation.
In the last turn in the historical legal action, the lawyers of Sandie Peggie asked the labor tribunal court for Dr. To bring in Kate Searle as a third 'respondent' in the case.
They claim that the A&E Consultant has harassed the 50-year-old nurse by ordering Mrs. Peggie's actions to a number of consultants before an investigation even took place.
Mrs. Peggie was suspended by NHS FIFE after she the presence of Dr. Beth Upton, who was born as a biological man, in the changing rooms for only women in the Victoria Hospital, Kirkcaldy, disputed.
She argues on an employment tribunal that are forced to change alongside Dr. Upton broke the Equality Act.
She has filed a claim against the Health Board and Dr. Upton claims sexual harassment, intimidation with regard to protected faith, indirect discrimination and victimization.
Dr. Searle – Dr. Upton's Line Manager and Confidant – is now set to be brought into the shooting line, will probably continue the pressure on the Health Council.
It comes in the midst of questions about the spiral -shaped costs of the tribunal for taxpayers.

On Tuesday, NHS Fife claimed that it could not release the actual costs of his legal account with regard to the Tribunal in response to a request for freedom of information respect on Sunday.
But insiders estimate that the legal costs – paid by the public wallet – will reach six digits and no less than £ 250,000.
If the judge agrees to Dr. Searle as the third respondent to bring in, its legal costs will also be increased by the Under-Fire Health Board.
The test of Mrs. Peggie started in August 2023 when they are Dr. Saw Upton use for the first time with the female dressing room in the hospital.
It culminated on Christmas Eve that year when the nurse entered the dressing room to find the doctor who started to undress.
Mrs. Peggie, who started working for FIFE Health Board in 1994, said she told Dr. Upton that it was “unacceptable” that the medic there was that she was “ashamed and intimidated” and she didn't think “that he should have been within it.”
A few days later she was suspended and on leave.
After the incident, the tribunal heard that Dr. Upton Dr. Searle in the early hours of Christmas Day e -mailed to express that she 'did not feel safe with the help of the changing rooms' while Mrs. Peggie was there.
The doctors met on December 29 and then e -mailed Dr. Searle senior staff in the hospital to tell them about 'next steps' and Mrs. Peggie and Dr. Upton not to have the same service.
She wrote in an e -mail that three other employees would inform SP [Mrs Peggie] The tribunal heard that her actions were unacceptable and to make a plan to continue.
Another e -mail from Dr. Seale sent on December 30 to another staff member thanked them for their support and suggested that she had had a long conversation with Dr. Upton and Dr. Upton knows we condemn SPS [Mrs Peggie’s] Actions'.
It is also said of the friends that they have discussed that Mrs. Peggie was reported to the police for possible crime for the 'misering' of the medic.
Mrs. Peggie's team is of the opinion that Dr. Circulars. Searle who convicted the actions of their client to a number of health council advisers before an investigation into its alleged behavior took place, victimization and intimidation.
Her lawyer Margaret Gribbon confirmed that the application had been submitted to the Tribunal court that Dr. Searle the third respondent and would be included in the case.
A spokesperson for NHS Fife said: 'NHS Fife has not established current legal proceedings and defends an action instead set by the plaintiff in this case.
'Central Legal Office, which is part of NHS Scotland, offers extensive legal services to health councils and other public authorities and represents NHS Fife in this promotion. NHS Fife is also part of the clinical negligence and other risks of compensation (Cnoris), which protects members against financial losses. All other costs quoted in connection with NHS Fife that defends the current labor tribunal case at this stage must be considered speculative. '
