A chartered accountant who killed a retired person in a frontal crash after falling asleep with his children with his children in the back, the prison was spared.
Jason Rana, 39, plowed in the 70-year-old Renate Soltys' car after he was unable to negotiate a turn on the 60 MPH B3230 in Muddiford, North Devon, and crossed to oncoming cars.
The father nodded on the wheel while he drove his sleeping young children, a six -year -old and three -year -old twins, from a trip to the beach at home.
Exeter Crown Court heard that Rana Paramedics told on the spot that he “felt his eyes go and have fallen asleep” who had been up for 6 hours that day.
The police said they were called at 3.40 pm to report reports of a traffic collision.
A judge heard that Rana woke up just before the collision of 100 MPH Impact and was on the wrong side of the road.
Public Prosecution Service Peter Coombe told the court that as a result of the crash, one of Rana's children suffered a broken arm and the accountant wounded wounds on his chest.
Rana, Van Barnstaple, Devon, admitted that he caused death by careless driving in June 2023.

Miss Victoria Bastock, defensive, said he was full of regret for the tragic outcome of the incident.
He told the police that he 'gave away and was stripped by what happened' with the victim who died on the spot.
The court heard after the inspicident he cried and continued to apologize to people on the crash site.
Mrs Soltys immediately died of catastrophic brains and other wounds.
Judge Anna Richardson sentenced him to a community order of 18 months and told to perform unpaid work for 150 hours.
She said: “There was a temporary decline of consciousness. This incident was entirely in character for you. '
Divorced Rana, who has no previous convictions, was also forbidden to drive for 12 months.
