But judge Bridget Bade, who was appointed by Trump, did not agree.
According to her, she argued that the trade unions have not met their burden to show that they are standing, and so the government will probably have the upper hand because the court had no jurisdiction to enter the provisional order. '
The conservative court further claimed that the order of the lower court does not actually 'recovery' the damage that the plaintiff claimed.
“Restoring the ended employees does not mean that they return to the same positions and assignments, or that the agencies will provide the services that the organizational claimants want,” Bade wrote.

Employees who should be restored under that ruling work for all agencies that are subject to the ELSUP order except the Ministry of Defense – who said it had dismissed around 360 probationary periods.
The Trump government appealed that decision. A court of appeal established in Richmond, Virginia recently refused to pause the decision pending the outcome of the case.
