Aussie home builder collapses owing over $3million to 100 creditors and leaving dozens of homes unfinished

Another Australian residential builder has collapsed, millions of dollars owe to creditors and leaving houses still unfinished or with defects.

Clarke Homes, located in the NSW Central Coast Region north of Sydney, was placed in administration, with a meeting of creditors on Wednesday.

Jonathan Allan Clarke is mentioned at the Australian Securities and Investments Commission (ASIC) as the only director of the company.

In addition to 100 creditors, Clarke Homes owed around $ 3.1 million, Clarke Homes Loon, annual leave, personal leave and Superannuation owes employees.

Many of the creditors are traders, contractors and suppliers, where one local company claims that it owes around $ 60,000 by the home builder.

“It has been learned a hard lesson, but it is a learned lesson,” the owner told the Daily Telegraph.

Among the creditors owed are Alesha McNamara and her husband who spent almost $ 400,000 on their 'dream house'.

The construction started in June 2022 by Hotondo Homes, who then changed his name to Clarke Homes.

The couple and their baby boys have been living in the house since the beginning of 2024, but there are many defects.

Mrs. McNamara said that during the construction process 'every trade (person) we spoke to owed money'.

'We had several jobs for starting and completing traders. We are just lucky that we finally have a house, “she said.

Although the house was fit enough to live in, Mrs. McNamara said that the defects such as gaps in the ceilings would cost tens of thousands of dollars to resolve.

Because she is currently on pregnancy leave, the couple cannot afford to solve these problems now.

“It certainly cost us much more than could have something for another builder,” said Mrs. McNamara.

He said hTurning on with defects must involve another builder to complete the rectification work and to claim an uncovered creditor in the administration.

It is, however, understood that Clarke Homes customers may have access to the insurance for home building Compensation Fund (HBCF), which offers a safety net for homeowners in the case of defective or incomplete work.

HBCF compensates homeowners for losses by defect and incomplete work in which the builder or trader becomes insolvent, dies, disappears or their building permit is suspended or canceled by the Commission for non-compliance.
