He must not use the charges yet.
The police claim that Allywa knew that the girl had not agreed to sexual activity, according to documents offered to the court.
Allywa's lawyer said the court that her client had been diagnosed with schizophrenia and an intellectual disability, according to the Daily Telegraph.
She warned that he would be 'particularly vulnerable' if he would stay in custody instead of the community, where he could see a psychiatrist every two weeks.
The lawyer also told the court that Allywa took care of various family members and that he would stay away from Lidcombe if he received bail.
But the public prosecutor argued that he would be a risk for the community, referring to earlier convictions, including offenses against victims who are unknown to him.
The public prosecutor claimed that Allywa had a history of the use of weapons and 'had little respect for public safety'.
