NEW DELHI: The Supreme Court on Tuesday upheld the validity of the Uttar Pradesh Board of Madrassa Education Act, which the Allahabad High Court had termed as ‘non-secular’ and ordered the closure of madrassas. However, it is said that the state has a vital interest in regulating madrassas to improve education standards.
The SC outraged that while the state regulates educational standards in madrassas, it cannot violate the right of the minority community to establish and manage an educational institution. The apex court said the HC erred in terming the Madrassa Act unconstitutional as it only allows the government to regulate educational standards.
The SC said madrassas that grant certificates beyond Class This means that the approximately 13,000 madrassas would continue to function in UP while the state regulates education standards.
