CCI recalls Flipkart’s antitrust investigation report following a complaint from Xiaomi

India’s antitrust agency has withdrawn its investigative report into competition law violations by e-commerce giant Walmart’s Flipkart, a document shows. This is the second step after a report about Apple was retracted in August.

China’s Xiaomi had complained to the Competition Commission of India (CCI) that the report – which found Flipkart, some of its vendors and smartphone players violating competition laws – contained commercial secrets that should have been redacted, Reuters reported in September.

According to two sources and an internal CCI document dated October 1 and seen by Reuters on Tuesday, the watchdog has ordered the recipients of the Flipkart report to destroy it and make an undertaking to do so to prevent further spread.

Xiaomi argued that the report included model-based sales, which is sensitive information.

The CCI document noted that some data and information had been “inadvertently” included in the report and provided interested parties with a new report, although it did not specify what changes it made.

Xiaomi declined to comment, while the CCI and Flipkart did not respond to Reuters’ queries.

In August, the CCI recalled an antitrust report on Apple after the company complained that commercial secrets had been revealed to some involved parties.

In a lengthy investigation that began in 2020, the CCI found that Flipkart, as well as e-commerce rival Amazon, favored selecting sellers and prioritizing certain listings, and also colluded with companies like Xiaomi, Samsung and Vivo to make phones exclusive on their mobile phones. websites.

However, much of the investigation process remains on hold after Vivo and some online sellers from the two e-commerce companies challenged their participation in the investigation and obtained court orders.
