Delhi High Court summons OpenAI in ANI case for copyright infringement
NEW DELHI: The Delhi High Court on Tuesday issued a summons against US artificial intelligence firm OpenAI on a plea alleging unauthorized use of content by the company to train and exploit its AI tool ChatGPT, violating copyright laws. This is the first such case in India against a US-based AI major.
HC sought the AI ​​major’s stand in a suit filed by news agency ANI (Asian News International) against OpenAI Inc and OpenAI OpCo LLC seeking damages of Rs 2 crore and a decree of mandatory and permanent injunction.
However, Judge Amit Bansal refused to grant any interim relief, pointing out that the case involved a “set of issues”, including issues arising “as a result of the latest technological developments in the field of copyright of various copyright owners”. HC indicated that it will appoint an amicus curiae in the lawsuit.
The court also recorded a statement from OpenAI’s lawyer that it has already removed links and blocked use of ANI’s content, including the agency’s official website.
ANI’s counsel emphasized that its content was used by OpenAI to train its chatbot ChatGPT, but it is not limited to copyright infringement. The lawyer cited examples in which he claimed that the AI ​​chatbot often wrongly attributed “fake news” to the news agency.
OpenAI insisted it has not committed any copyright infringement and assured the court that its AI tool corrects any errors that may creep in unintentionally. HC has posted the matter for hearing in January next year.
