PANAJI: Merely entering a hotel room with a man does not mean a woman consents to sex, the Bombay High Court in Goa ruled while quashing a court order dismissing a rape accused.
Judge Bharat Deshpande noted that the survivor came out of the hotel room crying and immediately filed a police complaint for rape. He said the additional hearings judge erred in concluding that the woman booking the hotel room and going there with the suspect meant she consented to sexual acts. sexual intercourse. The HC directed the court to file charges against the accused for rape and criminal intimidation, saying there was sufficient material to proceed against him.
Justice Deshpande said the trial judge “clearly mixed two aspects: going into a room with the accused without any protest, and giving permission for what happened in the room”.
The survivor alleged that the suspect took her to the hotel on the pretext of meeting an agent, who would get her a job abroad.
