Ex-CJI did 'nothing' against violation of anti-defection law: Sena UBT
NEW DELHI: Former CJI DY Chandrachud came in for sharp criticism from Sena UBTwho accused him of “doing nothing to violate anti-apostasy law about the divisions in the party”. The comments about the “pollution” of the Constitution came amid comments from other parties that there were serious questions about the independence of the judiciary under BJP government.
Sena UBT MP Arvind Sawant criticized the BJP’s repeated reference to emergency and said the way the Constitution is being ‘played’ now, there was an ‘undeclared emergency’ in force and there was no need to impose one to impose. He said the BJP should not forget that four SC judges had alleged that the government was interfering in the functioning of the judiciary.
Sawant said while the anti-defection law was being fragmented in Maharashtra, SC judges could not show courage to stop it. “Was the Constitution respected… illegal government was allowed to function, CM was sworn in. The matter was to be decided during the term of office, but the Speaker did not disqualify anyone. What happened to the SC order? What happened to the Constitution and Ambedkar happened?” he asked, adding: “Is the judiciary independent? There are cowards there.’
