A man remained stunned to find a fully grown man with a beard in front of his door after he was told through the UberEATs app that a female driver was on his way.

Last Saturday – similar to many other British throughout the country – Matt Stevens, 21, ordered a take -away to his house in Greenwich, London.

Based on information from the UberEATS -app, Mr Stevens expected a female driver to deliver his food around 9.30 pm.

But when his wonderful delivery arrived, the 21-year-old was shocked to find a man with a beard at his door with his dinner in tow.

“I walk outside, and there is an adult man who is there,” Matt told MailOnline: “So I thought, this can't be my delivery. '

After he had checked his data with the courier, it quickly insisted on the young man that it was actually his food – and his delivery person.

After the incident, Matt soon took a snap from the driver because he was not sure if he “lost his mind.”

But even though he claimed to have reported the incident Uber, Matt said he did not receive a response until his social media post went viral about this.

What is the Legal Maas in the law?

It is illegal for every company to hire illegal employees – those without a right to work in the UK – with substantial fines of a maximum of £ 60,000 per employee if a company does not perform correct checks.

But because all Uber directors are self -employed, they are not legally liable for a replacement director who may not meet these conditions.

Similarly, the account holders themselves are self -employed for Uber – and are therefore not legally liable under labor law.

Even if an account holder is consciously caught renting his account to an illegal employee, they will only be confronted with a ban from Uber Eats – while the employees may be confronted with deportation.

“I was quite surprised. I took the collection meal and I took a quick picture of him because I wanted to report it to Uber to find out what was going on, “he said.

“And I just received a series of automated messages from them. They just don't give it clear. '

'It was amazing and it is really important, not for me – I am an adult man and I was afraid – but I can imagine, for a woman in particular this would be amazingly scary.

“We have a political class that likes to sit and talk about the safety of women and girls, which is very admirable, but this is something that immediately endangers it.”

Matt in his own hands took his experience on X, in a tweet that has now been viewed 30.1 million times.

“I have had many messages from people around the world who told me that this happened to them,” he said.

'I had people in the UK who sent me their ring doorbell screenshots. It happens all over the world and throughout the country.

'It was only a bit scary for me, I am a man, but for a young woman, age of 17 or 18 years, who lived alone.

“I can imagine that this is a pretty scary experience who encounters a man she knows not to be documented.”

It comes after MailOnline exclusively discovered drivers rent their bills for thousands of pounds to illegal immigrant men who want to circumvent a criminal record and employment controls.

Account holders must verify their age, right to work, insurance and a background check, including a criminal check, before they can start delivering Uber Eats.

But some successful applicants fulfill large amounts of money for access to their accounts for total strangers – who may have a criminal record or cannot work illegally in the UK – no less than £ 5,720 per year.

The Uber website states: 'At any time during the delivery process you can choose to have someone else delivered on your behalf, provided that they meet the safety conditions.

“If you choose to do this, you must bear in mind that you are still fully responsible for all activities that are carried out on your account, by you or by your replacement.”

The conditions include that every replacement is older than 18, has the right to work in the UK, to pass on a criminal background control and insurance.

And it is based on deliverers who register the replacements online online – while some rent out their account without performing checks.

UberEATs -replacement conditions also say: 'You don't have to tell you uber eats before using a replacement.

'However, you will be asked to register them within 48 hours after that replacement provides delivery services on your behalf.

'This is to verify that they have the right to work in the UK. If they don't, you can lose access to your account. '

After the incident, Matt began to learn further about the 'Legal Loophole' that was previously discovered by MailOnline.

“The entire point of using Uber is so you can know who is supplying the food to you,” Matt added.

“You know they are familiar, they have a review, so you know who they are and you know it is safe to order with them – but apparently no longer.”

The 21-year-old compared it to hypothetically that teachers get their friends to take coverage lessons.

“It would be like there was a teacher, and the teacher was sick and said:” Oh, it's okay. I have a friend who can cover the lesson, “he said.

'These replacement drivers. They don't go through any checks. It is dangerous and it endangers the life and safety of people, “he added.

He described it as a 'frightening' test and said about his delivery person: 'No one in the world knows who he is.

“They have no way to know if they are an illegal immigrant. We have thousands in London. So who knows?

'I certainly don't want someone with a criminal record at my door, and I am sure that the majority of this country would feel the same.

'These companies [Uber] Must get a grip. They make a profit for the safety of the customer and that is a real problem. '

Matt suggested that the app would implement a regular Face ID check to ensure that the accurate courier performs the service, while also called on the government to take legislative action.

'The government must be legally against this. Companies can now act, but they are not because it is not in their interest to act because of their loss profit of money and drivers. '

Matt has since contacted his local MP, Matthew PennyCook, who is the Minister of the House and is waiting for a response about this.

Usually if a company employs someone who does not have the right to work in the UK and fails to ensure that they do that, they can be fined up to £ 60,000 per employee.

But because Uber drivers are self-employed, neither Uber nor the account holders are liable for fines such as people who work illegally, are subject to fine under employment legislation.

Instead, if an account holder uses a replacement without the right to work, only that their account is closed.

Partner at the British law firm Freeths Emma Booksbrank, which specializes in immigration legislation, said earlier that delivery companies come under increasing pressure because of the rise of people who have access to accounts, even though they do not have the right to work in the VK .

'Companies such as Uber Eats can offer access to a replacement, but the companies have been increasingly busy because there is this increase in illegal immigrants who have access.

'They have always maintained that employees are self -employed, and when challenges have been brought against them for labor rights, they went all the way to the Supreme Court.

'Uber does not really use the substitutes because all delivery staff is self -employed.

'The account holders are also not liable under the right to work legislation. Companies can get a fine of £ 45,000 to £ 60,000 anywhere, but the account holders do not act as employers because replacement drivers are also self -employed.

“It's a gap, a Maas in the law, and that's why it happens.”

A spokesperson for Uber eats: 'All couriers who use the Uber Eats app, whether it is the account holder or their replacement, must undergo checks to ensure that they are older than eighteen and have a legal right to be in the UK work.

'We require couriers to register their substitutes so that we can verify their right to work. Account holders who use substitutes who do not have the legal right to work in the United Kingdom will permanently lose access to their account.

'If a courier is marked for any infringement in our community guidelines, including illegal or unsafe behavior that we investigate and appropriate measures on the account, including access to the app permanently removing.

“We are constantly revising and improving existing processes to ensure that they are as robust as possible.”
