A criminal who left a graduate with a brain blood after launching a pathogenic attack at a gas station has been sentenced to prison.

Bernard Hirsch was left 'deep' disabled after he was attacked by Tyren Pollard outside of an ASDA store in December 2017, before he died two years later.

Mr. Hirsch's wife said he was unable to 'speak, write, to walk or move alone' after Pollard had hit him in the face, before he repeatedly hit Marchester with his walking stick on Marland Road.

The victim was later taken to the hospital, where scans showed that he had a bleeding on the brain. His injury contributed to his death two years later at the age of 43.

Pollard, 52 was convicted of manslaughter and the inflicting of serious physical injury after a process of Minshull Street Crown Court last year.

He was sentenced to two and five years for both counts, which he will serve simultaneously.

Jury members looked at CCTV of the two men – who both had mobility problems – who arrived at the gas station on the morning of 11 December 2017.

Mr. Hirsch, who suffered from Nephrotic syndrome and waited for a kidney transplant that spent nine months in the hospital before he was fired in August 2018.

After having spent time in a coma and with caregivers, Mr. Hirsch was again admitted with suspected COVID-19 on March 20, 2020 and died eight days later.

While a post-mortem established the coronavirus as his cause of death, pathologists concluded that his head injury also contributed.

A statement from Mr Hirsch Marzena's wife, read by public prosecutor Michael Brady KC, described him as a “caring man” who fully lived his life for the incident despite his condition.

She said, “I try to remember Bernard as he was and not the scale of a man he was before his death.”

Defensively, John Jones KC said Pollard believed that he “had any right to defend himself” and claimed that both men “have” put together mutual issues. “

He said that Pollard's actions were not 'premeditated' and described as 'impulsive, spontaneous and very short duration'.

Judge Maurice Greene emphasized that Pollard hit Mr. Hirsch several times. He said he was “at least one of the strokes that hit him in his head.”

Mitigating, Mr. Jones said that Pollard himself is disabled, which can lead to difficulties in custody. He also said that Pollard had recently risen.

Pollard, from Newbury Avenue, was sentenced to two years before counting one – the inflicting of serious physical injury – and five years for the number of manslaughter. The sentences will be performed simultaneously.

After the hearing, the detective sergeant Kirsty Wroe, from the Greater District of the Manchester police said,: 'Pollard's meaningless and completely unjustified attack left a man with a serious bleeding on the brain and drastically reduced his quality of life for two years until his death.

'His actions have left a family – behind – and all of whom have been strong and resilient in what an incredibly difficult few years has been.

“Pollard is now behind bars and I hope that Bernard's family now gets some closure, while they continue to rebuild their lives after his sad death.”
