A top -american lawyer has been appointed and is expected to submit a claim against the studio that claims discrimination.
It is the newest headache for the company about its £ 215 million live-action remake of the classic cartoon from 1937.
Last week it was revealed that Little People Actors planted a meeting of a rally outside of Disney's studios in California to protest against the use of CGI to portray the dwarfs.
Actress Ali Chapman, 50, who is 3ft 8 long, said: 'Seven talented small human actors who can play roles in the remake of live action and yet they chose to use cartoons. It is an insult and discriminatory. '
Last month, a Class Action law case was brought against Disney that accused the discrimination of visitors with disabilities in the theme parks.
It claims that it has introduced rules for passes that require that they announce medical information 'where other employees and guests can listen to'.
Disney denied the claim and said, “We are committed to offer a great experience for everyone … especially our guests with a disability.”
