The Gardner family did not ate their luxury Costa Rican Hotel for lunch or dinner the day for 14-year-old Miller, the son of ex-Yankees Hero Brett, was found dead.
The resort told TMZ that it still works with authorities to help clarify what led to the tragic death of the teenager last Friday.
The report adds that the hotel had an inspection on March 14 and scored 98.5 on a possible 100.
The Gardner family visited the $ 900-per night Arenas del Mar Beachfront & Rainforest Resort on the Pacific Coast of Costa Rica when Miller unexpectedly died in his sleep.
Provisional reports from Costa Rica's Judicial Investigation Police (OIJ) attributed death to 'suffocation as a result of intoxication related to food poisoning' after Miller's body was found with vomit.
Now, however, CNN has been told by the OIJ that Asphyxia is excluded because there was no obstruction of his airways.
