Miley's latest album, Endless Summer Vacation was released in March 2023 and contained the enormous hit flowers.
Flowers spent eight weeks at number 1 on the Billboard Hot 100 and broke countless streaming records.
Flowers won the Grammy for Record of the Year and Best Pop Solo Performance last year, while the album was nominated for album of the year and best pop vocal album.
As successful as Flowers was, the song and Cyrus are now confronted with a lawsuit filed by Tempo Music Investments, a stakeholder in the hit single from Bruno Mars 2013 when I was your husband.
Tempo filed a lawsuit in infringement on Miley against Miley's Single and accused it of 'deliberately copying' Mars' song.
The court case focuses on the texts in the chorus: “I can buy myself flowers/ write my name in the sand/ talk to myself for hours/ say things that you don't understand/ I can dance myself/ and I can hold my own hand/ yes, I can love me better than you can.”
Mileys lyrics seem to be modeled on the choir of Mars: “That I should have buy your flowers/ and you should have holding your hand/ you should have given all my hours/ when I had the chance/ brought you to every party because you wanted to make everything dance.”
Miley's lawyers have submitted themselves to reject the case in November, with the argument that the plaintiff does not have the exclusive rights of the number.

However, a judge rejected this argument and has noticed a critical 'misunderstanding' with regard to the meaning of 'exclusive rights', according to documents obtained by the Mirror US.
The ruling clarified: “ownership of” exclusive rights “should not be merged with 'exclusive ownership' of rights.”
'The' exclusive rights 'are some collective ownership of the co-owners' and the pace became one of the co-owners when it bought the catalog of the co-songwriter Phillip Lawrence.
The lawsuit can now continue with pace and the other songwriters Gregory Hein and Michael Pollack as claimants.
Bruno Mars is also a credited writer in the song, but he is not involved in the lawsuit.
