Investigate 2 conflicting orders posted on the court's website: Allahabad High Court
PRAYAGRAJ: The Allahabad High Court (HC) has directed the District Judge of Ghaziabad in Uttar Pradesh to investigate how two conflicting orders came into one case of defamation – one of which is unsigned – have been uploaded to the court’s website.
“As far as the conduct of the magistrate is concerned, the court finds that he has not exercised prudence. An unsigned contrary order has been uploaded. He has also not initiated any investigation against the staff concerned. The court has been informed that he is a junior magistrate. Therefore, in view of his career, I am not issuing any unfavorable order.” Justice Saurabh Shyam Shamshery said on a petition filed by Parul Agarwal.
The applicant’s counsel pointed out that the unsigned order states that the defamation complaint has been dismissed, while the signed version states that the defendant has been summoned under Section 500 (defamation) of the Indian Penal Code.
The magistrate apologized unreservedly, explaining that court staff had “inadvertently” uploaded an unsigned draft without his consent.
Agarwal’s defamation suit was referred back to the trial court for a fresh order in accordance with law “after hearing the complainant expeditiously, preferably within a period of three months if there is no legal impediment”.
