Kolkata rape, murder case: Court rejects CBI’s plea for drug test, accused Sanjay Roy refuses to consent | India News – Times of India
NEW DELHI: The Sealdah Court has the CBI’s request for a drug test for the suspect in the RG Kar Hospital case Sanjay Roy on friday.
The suspect was today summoned to a closed session at the Sealdah court to seek his consent for a drug test.
Earlier, Roy, the director of RG Kar College and others had already undergone a lie detector test.
The court said, “Accused Sanjay Roy did not give consent for the Narco Analysis Test. So, in law, this is unconstitutional and violative of his fundamental rights. As per the judgment of Karnataka case of 2010, the Supreme Court said regarding Narco Analysis Test that without consent no accused can undergo these tests. This is unconstitutional and privacy of the accused is violated.”
The Supreme Court of India, referring to the case of Selvi v. State of Karnataka, said that it is unconstitutional to use narco-analysis, brain mapping and polygraph tests on suspects without their consent. It further said that these techniques violate the ‘right against self-incrimination’ under Article 20(3) of the Constitution and the ‘right to privacy’ under Article 21. The court’s final judgment was that any evidence obtained through these methods without the free consent of the accused would be inadmissible in court.
Meanwhile, junior doctors are continuously protesting outside the Swasthya Bhawan against the rape and murder of the second-year PG student in the seminar hall of the college on August 9.
Earlier, members of the Communist Party of India (Marxist) also staged a protest in Kolkata demanding justice in the RG Kar Medical and Hospital rape and murder case.
Amid ongoing protests, the Chief Minister of Bengal also announced that she is ready to resign from her post amid the ongoing protests. “I am ready to resign as the Chief Minister of West Bengal. I am not worried about the post. I want justice for the victim, I am only worried about common people who are getting medical treatment,” the CM said, further assuring that no action would be taken against the protesting doctors.
Bengal Governor CV Ananda Bose had earlier said he would “socially boycott” Mamata Banerjee, whom he called “Lady Macbeth of West Bengal”.
“In solidarity with the Bengali society, I decide to socially boycott the Chief Minister. Social boycott means that I will neither share any public platform with the Chief Minister nor participate in any public programme that concerns the Chief Minister. My role as Governor will be limited to the constitutional obligations. Nothing more, nothing less,” the Governor said in a video message released on Thursday.
The court’s decision to dismiss the drug test left Internet users disappointed.
