Molly-Mae, worth an estimated £6m, is the sole owner of their 5,000 sq ft home.
Land Registry papers show that the gated mansion was bought for £3.8m in April 2022 in her name alone.
The discovery means Tommy is unlikely to retain any financial stake in the property and has no right to live there.
While married couples can make financial claims under the Matrimonial Causes Act, there is no provision for couples who are engaged or cohabiting.
Weronika Husejko from McAllister Family Law, explained: ‘In terms of any property that the pair own together, any disputes in relation to this would be treated as a ‘ToLATA”claim.
‘This is because the Trusts of Land and Appointment of Trustees Act 1996 is the legislation which deals with disputes relating to the ownership of property or land.
‘In a situation where the property was purchased by both of them and it is clear from the title deeds how the property is held, there is less scope for dispute.
‘However, if one of their names are not on the title deeds, it can become more complicated and will depend upon a number of factors.’
Financial adviser, Adam Garcia from the Stock Dork added: ‘Molly-Mae Hague and Tommy Fury own a £4 million mansion in Cheshire, which they purchased after a three-year search.
‘This six-bedroom property, which they have been renovating, stands as a major asset that could become a focal point in their separation.
‘The house’s ownership structure, whether jointly or individually held, will determine how it is divided.’

Molly-Mae has shared snippets of the luxury property on social media under an Instagram account called MollyMaison, which has more than 1.3m followers.
The property boasts 5,000 sq ft of land, plush marble tabletops, a home gym, walk-in wardrobes and a double shower.
It is described by developers as having ‘a contemporary-chic fit out and bohemian twist’ and ‘finished with bespoke materials and furnishings procured from around the world’.
Molly-Mae and Tommy announced that they had purchased the home in March 2022, with a source telling MailOnline: ‘Molly fell in love with the property as soon as she saw it. It has everything she had been looking for including a luxurious contemporary design, stylish interiors, and a landscape garden.
‘Molly also loved the bohemian influences, which is reminiscent of her travels to Ibiza and Tulum in Mexico.
‘She purchased the house straight from the developer so wasted no time in snapping up the property after being so persistent with her search for the perfect home.’
On August 7, just seven days before their split, Molly-Mae posted a YouTube video in which she said she had been ‘struggling’ and ‘solo parenting’ Bambi.
In a candid video posted on social media the Love Island star said she had spent weeks looking after their daughter Bambi on her own while her fiance was working elsewhere.
In recent weeks friends have revealed the couple had gone through a rocky patch and have been leading increasingly separate lives with cracks showing in their normally tight-knit relationship on social media.
Earlier this year Molly-Mae was seen without her £600,000 engagement ring on multiple occasions while Tommy was spotted partying with women on trips abroad.
In the clip, Molly-Mae explained Tommy had been predominantly absent from their family home while he was recording his audiobook.
She said: ‘Actually I’ve been solo parenting for like, two weeks now, basically because Tommy’s just been so busy.
‘When he’s home from doing work and stuff, he’s so incredible and so helpful. I can’t say any different, like, he’s such an incredible dad, but I have been this week, like, just really… mum life has been mum lifing.’

Tommy shared a separate post in which he asks his followers to ‘respect our privacy as we navigate through this difficult time’
She concluded: ‘I just feel like, at the minute I’ve been struggling a little bit.’
Tommy’s trips abroad to places such as Abu Dhabi, Saudi Arabia and Hungary for work and pleasure saw Molly-Mae left at home reportedly complaining she ‘doesn’t know where he is going’.
It wasn’t hard to spot him though, with Tommy – who is known to enjoy drinking alcohol, a keen contrast to the mother of his daughter – seen partying with his friends, and sometimes other women, on social media.
In October 2023 he was spotted partying with girls and singer Chris Brown in Abu Dhabi, with the boxer spotted getting close to an attractive brunette. His behaviour reportedly left Molly-Mae ‘mortified’.
