A preliminary on-site investigation found that a 27-year-old man deliberately threw a mobile phone at a 33-year-old female performer on stage and punched her in the face.

Nicolas claimed he had hoped Rexha would catch the device

“As a fan, Mr. Malvagna’s only intention was to get Ms. Rexha to take pictures with his phone and return them as a keepsake,” his attorney Todd A. Spodek told Dailymail.com. “It was never his intention to hurt Mrs. Rehxa.”

Malvagna’s attorney’s statement comes on the heels of a criminal complaint filed against him by the Manhattan District Attorney’s Office.

In it, a witness said that Malvagna had admitted to him that he threw the phone at the singer – and did so ‘because it would be funny’.

The witness told authorities he asked ‘who threw the phone’ after the incident, and Malvagna raised his hand and admitted.

The witness said Malvagna told him, “I was trying to see if I could hit her with the phone at the end of the show because it would be funny.”

Following the Sunday incident, Malvagna was released on her own accord and ordered to keep her distance from the singer pending a trial on the matter on July 31.

Malvagna faces a year in prison if convicted on the charges, the DA’s press secretary, Douglas Cohen, said, according to NBC News.
