A 77-year-old Oakland man has been arrested after fatally shooting a suspected burglar.

Police say two men and a woman stopped at the man’s home Monday evening in a stolen car.

One suspect reportedly held a crowbar as the three entered the man’s home, as reported by KTVU.

The homeowner, who has not been publicly named, apparently shot one of the men, the woman in the group told officials.

He pointed the gun at the woman when police arrived, officials said.

The third suspect was found at the scene with a replica pistol and was arrested on suspicion of burglary.

The homeowner has been arrested on suspicion of murder while the Alameda County district attorney considers whether to file charges.

Police say the gun used by the homeowner, a Colt Python revolver, was stolen.

Prosecutors have until Thursday to decide whether to charge the homeowner, who has reportedly refused to talk to investigators.

It comes after an East Oakland resident shot and killed robbery suspect Charles Calloway in March.

Calloway’s accomplice David Washington was charged with the murder, even though it was the homeowner who pulled the trigger, according to reporter by sfist.

The homeowner was also shot in the foot during the shootout with the suspects.

Prosecutors are pursuing charges against Washington, arguing that he provoked the homeowner to fire the shot that killed Calloway.

California law allows homeowners to use deadly force if they believe they are threatened in their home.
