Influencer Skye Wheatley’s traditional boyfriend is suing a wealthy travel baron, claiming the businessman owes him nearly $60,000 for unpaid work at a convenience store.

Lachlan Tony Waugh, 33, owner of Shopfit Co Pty Ltd, claims Dany Girgis and his company Kokomo Living Pty Ltd owe him a $59,516 bill.

The money reportedly owed is for interior fittings at Beloporto burger bar in Surfers Paradise on the Gold Coast.

Shopfit billed Mr Girgis and Kokomo Living for more than $44,000 in June last year, according to a claim filed in Southport District Court in February.

Mr Girgis, owner of a $4.5 million waterfront home in Kogarah Bay, Sydney’s south, and his company paid $20,000, leaving a remaining balance of $24,279.

They received another bill for more than $22,000 in July, and a third bill for payment of more than $13,000 in November – all equal to $59,516.

Shopfit emailed Mr Girgis and Kokomo Living in November about the unpaid bill, according to a claim.

“The First Defendant and the Second Defendant as guarantors have failed, refused or failed to act and continue to refuse to pay the plaintiff without any reasonable cause,” the claim read.

That same day, Mr Waugh’s company notified Mr Girgis and company that all work on the burger bar would be halted ‘due to non-payment of monies’.

Shopfit also made reservations about Mr Girgis’ Surfers Paradise apartment and his two shops in December as their legal stoush continues.

But Mr Girgis is now taking a stand against Shopfit, admitting that while the bills were unpaid, the company’s work was inadequate.

Mr Girgis is now seeking damages for breach of contract and missed opportunities.

He also claims he was not given written notice that the company stopped working on the burger shop.

Mr Girgis has claimed the delays in work caused him to lose Beloporto’s tenant and rental income – with a new tenant taking over and the burger shop never opening.

He also claims he had to pay new tradesmen to come in and get the job done.

The millionaire alleges that Shopfit failed to take reasonable care to complete the work.

He claims that Kokomo Living lost $197,000, $94,000 of which was to complete the incomplete and incorrect work.

He also claims he lost more than $16,000 in lost rent and $25,000 in additional electrical work.

Mr Girgis also claimed that Shopfit had made a ‘misrepresentation’ about how long the fit-out would take, claiming that he would not have signed the contract had he known the actual time frame.

Mr. Girgis is the corporate director of Sure Thing Travel, which offers experiences and travel packages for young people going on vacation, particularly for Schoolies groups.

He also owns two stores along The Esplanade in Surfers Paradise where Beloporto was to be built.

Mr Waugh is Wheatley’s celebrity partner, who rose to fame after appearing on Big Brother in 2014, and is now an influencer with over 620,000 followers.

He regularly appears in her social media videos and shares two sons with Wheatley.
