Pauly Shore is facing charges of alleged 'battery' and 'assault' after a man claimed he was assaulted by the star's security at The Comedy Store during an incident that took place in November 2022.

In documents obtained by The explosion On Thursday, Sean Kehoe and his daughter Kirra Lyn Potts filed the lawsuit, claiming they both suffered “serious injuries” after the attack.

On the night of November 30, the pair were guests at The Comedy Store in West Hollywood — which is notably owned by Shore — when security allegedly “forcibly grabbed and assaulted” Kehoe.

In the lawsuit, his daughter, Kirra, further alleged that the Encino Man actor was aware of security's plan of attack and “encouraged” the altercation.

She further stated in the documents that after witnessing her own father being attacked, it caused her to experience “emotional distress.”

DailyMail.com has contacted Pauly's representatives for comment.

In addition to assault and battery, Kehoe and Potts have also charged the comedian with “intentional infliction of emotional distress,” “negligence,” “corporate liability” and “negligence in hiring unsuitable employees.”

The two are also seeking compensation in the form of damages for medical bills, and have also asked for coverage for their attorney fees.

In the documents, the father-daughter duo also asks for “compensation for all damages suffered” during the incident.

The lawsuit also does not specifically state what caused the altercation, according to The Blast.

The Comedy Store was founded in 1972 by Pauly's father, Sammy Shore, his wife Mitzi and writer Rudy de Luca. The following year, Mitzi began directing the club's nighttime activities – and died in 2018 at the age of 87.

The revelation of the lawsuit comes shortly after Pauly was cast to play Richard Simmons in an upcoming biopic about the reclusive fitness star.

Ahead of the feature, however, Shore can already be seen as Simmons, 75, in a short film called The Court Jester, which will screen at the Sundance Film Festival – although it is not in the official lineup.

Shore has even teased fans that his portrayal could potentially lead him to an Oscar in 2025.

Earlier this week on Wednesday, Pauly messaged Simmons while he was talking TMZ hoping to get his blessing in terms of the biopic film.

While at the Hollywood Burbank Airport, the comedian encouraged Richard to watch the short film and asked him to “watch it with an open heart, not see how it comes in and say, 'I don't want to do this.' .. “'

He added, “Look at it with your open heart and just be vulnerable and just be, 'What do you think?'

“Based on that, and if you feel like it's still messed up and it doesn't align with your integrity and your thing, let us know. But in the meantime, we're going to try to move forward with this piece.'

He later added, “I would like Richard Simmons to be part of the feature film, physically to be on set with me.”

'…Ultimately we would like to have him there, but if he doesn't want it, then I still have to receive his message. My mission is to get his message out and save lives.”

Last year, Shore revealed his intention to play the beloved '80s fitness icon, known for his bubbly personality and colorful gym clothes.

“I noticed all the backlash about playing Richard Simmons in a new biopic so I reached out to him,” he wrote on Facebook in September.

Simmons – who has not been seen in public since 2017 – is said to be not interested in participating in the biopic.

Shore added in his message, “I heard he lives deep in Big Bear. We played phone tag (yes, he still has a phone). I'm trying to make it happen for you.

'Be optimistic. In the meantime, visit Hulu, Amazon, Disney, HBO and all the major producers. I can definitely turn into this man. I'll see you at the 2025 Academy Awards.

Last July, Simmons made an extremely rare public statement to celebrate his 75th birthday.

Although he did not share a personal message with the audience and his fans, he did allow his representative to speak on his behalf.

'This is a big milestone. I just want to see him happy, and he is,” his rep Tom Estey told ET about the special occasion.

It was a rare form of communication from the former fitness guru, who has largely hidden from the public eye since 2014.

He was previously spotted in 2017 when he left a hospital after being treated for serious digestive problems.

However, he tried to avoid being seen by covering himself almost from head to toe with a blanket, which then forced his housekeeper to lead him to a waiting car.

Despite Simmons' recent reclusive years, fans showed he was still in their hearts and minds when they stopped by his home on Thursday to personally wish him a happy 75th birthday.

Although they probably didn't see him in person, two people were seen holding birthday balloons and a sign that said “Happy Birthday Richard!” We love you!'

His exit from the spotlight shocked many friends and admirers at the time, even spawning an investigative podcast, documentaries and half-baked claims that his housekeeper was holding him hostage.

Since 2014, Simmons has spoken to the public only through a few phone interviews and rare statements from his representatives.
