A Manhattan judge on Wednesday declined to impose sanctions on Michael D. Cohen, the former fixer for former President Donald J. Trump, after he accidentally gave his lawyer false legal citations concocted by Google Bard, an artificial intelligence program, for a motion filed by the attorney. was preparing on behalf of Mr. Cohen.

The lawyer, David M. Schwartz, cited the bogus cases in his petition, which was filed in Federal District Court.

The judge, Jesse M. Furman, said the episode was embarrassing and unfortunate, but he had accepted Mr. Cohen’s explanation that he did not understand how Google Bard worked and that he had not intended to deceive Mr. Schwartz. The judge also said he had not found that Mr. Schwartz had acted in bad faith.

“Indeed, it would have been downright irrational for him to have presented Schwartz with false cases to include in the motion, knowing them to be bogus,” Judge Furman wrote of Mr. Cohen, a former lawyer who has been disbarred, given the likelihood that Mr Cohen will be excluded. Schwartz, the government or the court would discover the problem, “with potentially serious adverse consequences for Cohen himself.”

The issue was raised in a case involving tax evasion and campaign finance violations committed by Mr. Cohen on behalf of Mr. Trump. Mr. Cohen pleaded guilty in 2018 and served time in prison. He had asked for an early end to the court’s supervision of his case, after he was released from prison and fulfilled the conditions of his release.

Judge Furman had denied three previous such requests from Mr. Cohen. In his latest filing, his lawyer, Mr. Schwartz, pointed out that his client testified for two days last fall in the civil fraud trial of Mr. Trump in New York state. Mr. Cohen’s “willingness to come forward and make truthful statements,” Mr. Schwartz argued, “demonstrates an exceptional level of remorse and a commitment to upholding the law.”

But Judge Furman said that Mr. Cohen’s testimony in the state trial “in fact provides grounds for denying his request, not granting it.” The judge cited Mr. Cohen’s testimony in the civil trial in which he admitted that he lied in federal court when he pleaded guilty to tax evasion, which he now says he did not commit.

A lawyer for Mr. Cohen did not immediately respond to a request for comment on Judge Furman’s ruling.

Mr. Cohen’s credibility will be at the heart of Mr. Trump’s first criminal trial, set to begin in Manhattan in mid-April. Mr. Cohen, one of the prosecution’s star witnesses, was involved in the hush-money deal at the center of the case, brought by the Manhattan district attorney’s office. Mr. Trump’s lawyers could try to use Mr. Cohen’s inconsistent statements during the civil fraud trial, and possibly even Judge Furman’s ruling, to portray him as a liar. But the district attorney’s office will likely counter that Mr. Cohen has told many of his previous lies on Mr. Trump’s behalf, and that he has been telling a consistent story about the hush-money deal for years.

The judge overseeing the civil fraud trial, Arthur F. Engoron, had said he found Mr. Cohen’s testimony “credible” and imposed a crushing $454 million judgment on Mr. Trump.

It was in his request to end judicial supervision of his case that Mr. Cohen sought to assist his lawyer, Mr. Schwarz.

Mr. Cohen said in an affidavit in December that he had not kept pace with “emerging trends (and associated risks) in legal technology and did not realize that Google Bard was a generative text service that, like ChatGPT, citations and could show descriptions. that looked real, but in reality were not.”

Mr. Cohen also said he had not realized that Mr. Schwartz “would drop the cases in their entirety without even confirming that they existed.”

Mr. Cohen asked Judge Furman to exercise “discretion and mercy.”

The case is one of several to surface in Manhattan federal court in the past year in which the use of artificial intelligence has tainted the trials. Nationally, there have been at least 15 cases in which lawyers or litigants representing themselves were alleged to have used chatbots for legal research that ended up in lawsuits, according to Eugene Volokh, a law professor at UCLA who has written about artificial intelligence and the law.

The issue entered the public consciousness last year after Judge P. Kevin Castel, also of Manhattan federal court, fined two lawyers $5,000 after admitting they submitted a brief filled with non-existent decisions and legal citations generated by ChatGPT.

A series of similar cases in federal courts in Manhattan followed.

In one case, an attorney acknowledged that she had cited a “non-existent case” – Matter of Bourguignon v. Coulated Behavioral Health Services, Inc. – which she said was “suggested by ChatGPT” after her own research failed to reach a decision supporting an argument she was making. In January, the U.S. Court of Appeals for the Second Circuit referred her to a court panel that investigates complaints against attorneys.

And in another case, Federal District Court Judge Paul A. Engelmayer rebuked a law firm in Auburn, NY, which openly admitted that it had used ChatGPT to substantiate a request for attorney fees in a lawsuit against the New York State Department of Education. York City.

Judge Engelmayer said ChatGPT’s “invocation of support for its aggressive bid is completely and unusually unpersuasive.”

The cases highlight the challenges facing the legal profession as lawyers increasingly rely on chatbots to draft legal briefs. The artificial intelligence programs, such as ChatGPT and Bard (now known as Gemini), generate realistic responses by guessing which text fragments should follow other sequences.

Mr. Cohen wrote in his statement that he understood Bard to be “a supercharged search engine” that he had used in the past to obtain accurate information. The cases he found and passed on to Mr Schwartz appear to have been “hallucinations” – a term used to refer to chatbot-generated inaccuracies.

The episode became public in December when Judge Furman said in an order that he could not find any of the three decisions Mr. Schwartz cited in his motion. He ordered Mr. Schwartz to provide him with copies of the decisions or “a thorough explanation of how the motion was made to cite cases that do not exist and what role Mr. Cohen played.”

Mr. Schwartz said in his own statement that he had not independently reviewed the cases Mr. Cohen had presented because Mr. Cohen indicated that another attorney had given him suggestions for the motion.

“I sincerely apologize to the court for not personally reviewing these matters before submitting them to the court,” Mr. Schwartz wrote.

Barry Kamins, a lawyer for Mr. Schwartz, said Wednesday: “We are pleased that the court has deemed this error as one not made in bad faith by Mr. Schwartz.”

Andy Cohen swears the last half of Vanderpump Rules season 11 is completely binge-worthy.

He continued: “It’s taking off in a big way. Kudos to the brilliant team, and what a final. And what a reunion it will be. I’m so excited. Again, not my show, this is not a paid advertisement. No one asked me to post this message. It’s really good.”

Originally shared by Cohen via his Instagram Story, the video was reposted X (formerly Twitter) Friday, prompting a response from Tom Schwartz. “The second half is so solid,” he replied in a follow-up tweet, which confirms Cohen’s excitement. “One of my favorite seasons so far. Last month Bravo producer and personality Cohen, 55, was accused of ‘engaging in cocaine use with Housewives that he employs,’ according to a suit filed in New York’s Southern District by McSweeney, 41.

A rep for Cohen told Dailymail.com that ‘the claims against Andy are completely false’ at the time and now, a letter from Cohen’s attorneys obtained by TMZ has urged McSweeney to retract her ‘categorically false’ allegations or face a lawsuit.

Cohen’s attorneys have said everything McSweeney claimed in the lawsuit is false and added on the cocaine claim: ‘[W]e demand that you immediately retract and withdraw all allegations relating to Mr. Cohen’s purported ‘cocaine use.'” –

‘To be clear: these allegations are categorically false. Mr. Cohen never used cocaine with any cast member on any Real Housewives show or with any other Bravo employee. The absence of any reasonable basis to make such allegations is confirmed by your pleading itself.’

His attorneys point out there are no details included in the allegation and claim McSweeney made the explosive claim ‘just to get headlines and a quick payday.’ 

Cohen’s lawyers end by saying: ‘The truth matters. Litigation cannot be used to create fake news. And it cannot be used as a vehicle to spread false and malicious lies, in furtherance of a shakedown. We demand that you issue an immediate public retraction and apologize to Mr. Cohen. Every day you fail to do so only increases the damages suffered by Mr. Cohen.’

A source close to McSweeney told the publication that she is ‘flabbergasted’ that Cohen keeps bringing attention to the case in the press ‘rather than just letting it play out in court.’

A source close to Cohen said: ‘Of course, Andy should defend himself in the public with the truth. Why should she be allowed to spew lies about his character?’

DailyMail.com has contacted representatives for Cohen and Bravo for comment. 

McSweeney’s attorney, Sarah M. Matz, of Adelman Matz P.C. told DailyMaillcom: ‘That Andy Cohen had his counsel and PR agents write a threatening letter to give to the press is hardly surprising. 

‘Mr. Cohen is accustomed to using his power in the media to scare and intimidate people like Ms. McSweeney so that they will not speak out. Mr. Cohen’s attempt to discredit and intimidate Ms. McSweeney to deter her from engaging in legally protected activity in Court is exactly the type of retaliation that this lawsuit was brought to address and only is further evidence for Ms. McSweeney. 

‘We do not intend to litigate this matter in the press, and if Mr. Cohen wants to address Ms. McSweeney’s claims, we suggest he do so in Court, not in a letter for the press.’

McSweeney’s lawsuit filed last month against Cohen and Bravo alleges cocaine use is rampant at the the network, with the linchpin producer and on-air personality both using the illegal drug and providing it to employees.

McSweeney said in court docs reviewed by Page Six that Cohen ‘tends to provide the Housewives with whom he uses cocaine with more favorable treatment’ and strategic editing to make them look better.

McSweeney appeared on two seasons of The Real Housewives of New York City in 2020-2021, and on a season of Real Housewives: Ultimate Girls Trip, which aired last year.

McSweeney said in the legal docs that Bravo ‘thrives off drug and alcohol use,’ without naming any further parties past Cohen.

McSweeney said in court docs reviewed by Page Six that she informed Bravo producers prior to her casting on the series, that she had been focused on staying sober, and had a 30-day streak of sobriety going into the show.

McSweeney told the court that producers failed to make a ‘reasonable accommodation’ for her addiction-related disability – but instead provided her ‘with unlimited, free-of charge alcoholic beverages,’ and ‘encouraged her to consume those alcoholic beverages.’

McSweeney’s legal team said that ‘this environment caused Ms. McSweeney to relapse into alcohol addiction shortly after joining RHONY season 12.’

McSweeney said in legal docs that Bravo and Shed Media, a production company it works with on its shows, continued to promote the unnamed senior producer in question ‘to positions of increased power.’

In ‘failing to take appropriate remedial action’ amid the claims, McSweeney said in court docs, Bravo and Shed officials ‘tacitly’ signaled to both the senior producer and ‘all other employees that they can engage in unlawful employment practices with impunity.’

McSweeney in her suit, which is for unspecified damages, named Cohen, Bravo, Shed Media and Shed’s parent company Warner Media.

The latest claims come amid a series of lawsuits filed involving Cohen, who also is the host of the Bravo series Watch What Happens Live! and executive producer of the Real Housewives franchise.

Brandi Glanville, 51, claimed in an explosive legal letter earlier this month that Cohen had sexually harassed her by trying to make her watch him have sex with another Bravo star, who Cohen later revealed to be Kate Chastain of Below Deck fame, via a FaceTime video.

In a legal legal letter DailyMail.com obtained, Glanville said that in 2022, an ‘obviously inebriated’ Cohen sent her a clip in which he ‘invited her to watch via Facetime,’ Glanville’s attorney Bryan Freedman said.

Cohen, who is openly gay, earlier this month posted an apology via Twitter: ‘The video shows Kate Chastain and I very clearly joking to Brandi.

‘It was absolutely meant in jest, and Brandi’s response clearly communicated she was in on the joke. That said, it was totally inappropriate and I apologize.’

Glanville on Monday said that the apology meant nothing to her since it wasn’t addressed to her.

Sources who saw the video in question told Dailymail.com on Tuesday that Glanville replied to Cohen’s video message in saying she would provide a sex toy for the referenced rendezvous.

Insiders said Cohen told Glanville in the 2022 clip, ‘Hey Brandi what’s up girl? We are just thinking about you. So yeah, me and Kate are gonna have some hot sex and wanted to know if you wanted to watch. You know a little ménage à trois. So FaceTime us back. Okay girl love you!’

Glanville sent a reply in which she said, ‘I will bring my hot dildo,’ according to eyewitnesses.

Glanville is also at the center of separate sexual harassment litigation involving fellow Bravo personality Caroline Manzo, 62.

The Real Housewives of New Jersey star said that Bravo producers encouraged Glanville to sexually harass her amid the filming of the series The Real Housewives Ultimate Girls Trip in Morocco, TMZ reported January 26.

Manzo said in legal docs that Glanville – after being encouraged to drink to excess by producers – ‘forced her vagina against her back’ as she groped her in front of the cameras.

Hollywood star Isla is married to English actor and comedian Sacha Baron Cohen, 52, and they share three children.

Multiple Real Housewives Franchise stars are coming Andy Cohen‘s defense follows Leah McSweeney‘s bombshell claims against the Bravo boss.

The former RHONY star filed a lawsuit against Cohen and Bravo on February 27. After news of her civil suit became public, she claimed in a lengthy Instagram post that network executives “create a dangerous work environment and encourage substance abuse.”

McSweeney alleged that NBCUniversal exploited her struggle with alcoholism, alleging that Cohen “used cocaine with ‘housewives’ and other Bravolebrities he employed,” according to court documents obtained by Page six. McSweeney also claimed that Cohen “rewards housewives he uses cocaine with with more favorable treatment and edits” during the shows. (We weekly has contacted Cohen, Bravo and McSweeney for comment.)

McSweeney further claimed that she felt “pressured” to drink when she was talking RHONY despite allegedly telling producers before her first season that she had already been sober for 30 days. (McSweeney joined the series for seasons 12 through 13, which aired in 2020 and 2021.)

Although Cohen has not addressed the lawsuit directly, his representative dismissed McSweeney’s allegations in a statement The Hollywood Reporter on Feb. 28, saying, “The claims against Andy are completely false.”

Andy Cohen has rejected the claims against him Real Housewives of New York City alum By Leah McSweeney court case.

In the lawsuit, McSweeney says Bravo had a “rotten workplace culture that was uniquely dependent on pressuring its employees to consume alcohol.” She claims that she told producers before her first season that she had been sober for 30 days and was working to maintain her sobriety, but that she was pressured to drink all three seasons she appeared on the show and claims that producers “took revenge on her when she wanted to.” maintain sobriety, and willfully failed to provide reasonable accommodations that would assist her in maintaining sobriety and performance.

While filming abroad in Thailand, McSweeney claims her rights were violated when she was not allowed to seek care for her addiction problems and was denied proper transportation to Alcoholics Anonymous meetings during filming after she was told that participating would be ‘no problem’. Leah McSweeney has filed a civil lawsuit against Bravo and Andy Cohen after her experience filming Real Housewives of New York City And Real Housewives: Ultimate Girls Trip.

This is evident from court documents obtained by Page six On Tuesday, February 27, the reality star and her lawyers allege that Cohen, 55, and the network deliberately took advantage of McSweeney’s battle with alcoholism in an effort to score high ratings.

“This is not a story I ever thought I would tell; In fact, I was terrified to speak about it and was warned not to,” McSweeney, 41, said via a Instagram post hours after the charges were filed. “Your favorite Bravo shows are run by people who create a dangerous work environment, encourage substance abuse to create artificial drama, and cynically prey on the vulnerabilities of their employees.”

Although McSweeney said some of the stories detailed in the lawsuit have been shown on TV in edited form, viewers can learn much more as the case plays out in New York.

“Much more will emerge when those involved are questioned under oath. Today I take back my reality,” she said. “The reckless and diabolical way in which those at the top drool over the misfortunes and misfortunes of women, including myself, is disturbing. It is a workplace culture where toxicity, alcoholism and pain are not only expected, but encouraged and facilitated. That is something I absolutely did not sign up for and would never endorse.”

McSweeney appeared in two seasons of Real Housewives of New York City between 2020 and 2021 and one season of the spin-off Real Housewives: Ultimate Girls Trip in 2023.

In the lawsuit, McSweeney said she told producers before her first season that she had been sober for 30 days and was working to maintain her sobriety.

Instead of providing adequate care and support during her filming experience, McSweeney and her legal team alleged in the lawsuit that producers pressured her to drink throughout all three seasons.

“There is nothing more important than my sobriety, without it I risk losing everything,” McSweeney said via Instagram. “I have been very transparent about my addiction and recovery, but there are personal things in the trial that I have never wanted to reveal for fear of being judged and shamed, but I am now at a point in my life where I feel strongly enough feel to withstand whatever comes my way.”

While McSweeney said she has “love and respect for many” of the Bravo talent she has met and worked with over the years, she hopes her lawsuit “helps reality TV adjust to its true goal: to authentically portray the complexities of life while offering genuine support to those who share their stories.”

“I’ve been trying to address this internally for years, but every time since then I’ve been fired, put up against the wall and (basically) gaslit,” she said. “Bravo can try to manipulate my reality and the reality of others all they want, but the cold hard facts of this case are as real as it gets. Andy Cohen has addressed Brandi Glanville‘s recent allegations of sexual harassment against him.

“The video shows it Kate Chastain and I was clearly joking to Brandi. It was definitely meant as a joke, and it was clear from Brandi’s reaction that she was in on the joke,” Cohen, 55, wrote via X on Thursday, February 22. “That said, it was completely inappropriate and I apologize.”

Cohen referred to a video he allegedly sent to 51-year-old Glanville in 2022, where the former Real Housewives of Beverly Hills star alleged that Cohen was drunk, according to a letter from Glanville’s legal team sent to NBCUniversal, Shed Media and Shed’s parent company Warner Bros. Discovery, per Variety.

The letter claimed that the Watch what’s happening live The host told Glanville that he wanted to “sleep with another Bravo star” while he was “thinking” about her. Cohen allegedly invited Glanville to watch him have sex via FaceTime. The letter did not reveal the identity of the other reality star.

In January 2023, it was reported that Glanville and Manzo left filming of the Housewives spin-off early after Glanville allegedly kissed Manzo multiple times without her consent.

The documents alleged that Glanville did not attend the mandatory sexual harassment class for the cast and that she allegedly faced no consequences for it.

The filing also included details of the alleged meeting between Manzo and Glanville.
