Alleged double murderer Beau Lamarre-Condon has been officially removed from the NSW Police Force.

Lamarre-Condon is accused of murdering Sydney couple Luke Davies and Jesse Baird with his service weapon while off duty at a Paddington property on February 19.

The couple’s bodies were found on February 27 in surfboard bags on a rural estate in Bungonia near Goulburn, about 200 kilometers south-west of Sydney.

NSW Police confirmed Lamarre-Condon had been removed from the force on Friday.

“Under section 181D of the Police Act 1990, the Commissioner has the discretion to dismiss officers if she has lost confidence in their suitability to continue as a police officer,” the force said.

Detectives allege Lamarre-Condon’s murder of Mr Baird with his police-issued weapon was a premeditated attack following a months-long campaign of “predatory behavior” against the man with whom he had a brief “friends with benefits” relationship.

Police say Mr Davies, a Qantas flight attendant, was killed because he happened to be at the Paddington premises at the time his partner was murdered.

About 12 hours later he is said to have collected the bodies into a white rental van and taken them to a remote farm in Bungonia, about 180 kilometers south of Sydney.

He is said to have returned to the site to move the bodies to another location about 20 minutes away.

Initially, Lamarre-Condon did not want to tell police where their bodies were located and an extensive search was conducted for the couple.

He then spoke with an attorney on February 27, over a week after the alleged murders.

Lamarre-Condon was charged with two counts of murder and is currently in the Silverwater Correctional Complex, in Sydney’s west.

He will appear in court at the Downing Center in Sydney on April 23.

Two iconic tourist spots in northern NSW will be officially known by their Indigenous names following calls from the community to recognize their important cultural heritage.

Walgan, meaning ‘shoulder’ in the Bundjalung language, will be the double name for Cape Byron, the easternmost point of the Australian mainland.

The area is a popular tourist spot in Byron Bay and is important to the Arakwal and other Bundjalung people as a place for important gatherings and ceremonial practices.

Nguthungulli, said to be the Father of the World, will be the double name for Julian Rocks, one of Australia’s best diving sites, located 2.5km from Cape Byron.

The easternmost point of the Australian mainland, Cape Byron (pictured), is renamed Walgan, meaning ‘shoulder’ in the Bundjalung language

It is an important and sacred Aboriginal site associated with several dream stories of the Arakwal and other Bundjalung people.

The NSW Geographical Names Board approved a submission from the National Parks and Wildlife Service to officially double name the areas.

The board and Byron Shire Council will also formally name a reserve in the suburb of Bangalow as Piccabeen Park.

‘Piccabeen’ is a Bundjalung word used to describe the Bangalow palm and the baskets made from its leaves.

The move comes after Queensland’s Fraser Island was renamed K’gari in 2023 and Magnetic Island became Yunbenum last month.

In 2020, the King Leopold Ranges in Western Australia became the Wunaamin Miliwundi Ranges, while moves are being made to rename Lake Macquarie in NSW, with Galgabba one of the options being considered.

Minister for Customer Services Jihad Dib said the NSW Government is committed to preserving and promoting Indigenous language and culture through place naming.

“All Australians share a relationship with the land and the names we give to places convey their meaning, sense of history and identity,” he said.

“Dual naming recognizes the importance of Aboriginal culture and represents a meaningful step towards the process of unity in NSW.”

Minister for Aboriginal Affairs and Treaty David Harris said the Arakwal and other Bundjalung people have had continuous ties to these places through stories, kinship and language since the first sunrise.

“It is only right to honor that history and that connection through names that bring the story and language to life for all Australians to enjoy,” he said.

A Liberal MP’s new wife has left him just two months after their fairytale wedding and amid a party investigation into him bombarding an ex-lover with “ugly and undignified” text messages.

NSW Upper House MP Taylor Martin married his girlfriend Brittany in December in a luxurious ceremony at Sydney’s Grounds of Alexandria in front of about 110 guests.

But within eight weeks the relationship was over and Brittany and her three-year-old daughter left the home they had shared with Mr Martin on the state’s central coast.

A source close to the former couple said Brittany is now seeking help as the mother of one deals with the ugly split.

“I was shocked to hear that the marriage had ended so quickly,” says an insider.

‘Before the wedding he was nice to everyone, he had even been on holiday with her family.

“He seemed completely in love with Brittany and so happy… it all got annoying as soon as they got married.”

The wedding took place just five months after Mr Martin publicly apologized for past behavior when his former boss and partner, former federal MP for the Central Coast seat of Robertson Lucy Wicks, made a formal complaint to the NSW Liberal Party . She accused him of verbally abusing her over a period of five years.

Mr Martin publicly apologized for a series of text messages – leaked to the media – he sent Ms Wicks during that period in which he called her a “stupid bastard” and a “bloody pig” and promised to help in case of any problems. investigation into the allegations.

He said at the time: ‘I was young and inexperienced and I became involved in a situation that was far beyond my ability. There were heated words during my attempts to break up, which I sincerely regret.

“It was an ugly and undignified divorce.”

The couple’s relationship soured in 2019, when Mr. Martin was 29 and Ms. Wicks was 46. Mr. Martin first worked as a staffer in Ms. Wicks’ office when he was 24.

The wedding took place just five months after Mr Martin publicly apologized for past behaviour, after his former boss and partner Lucy Wicks filed a formal complaint accusing him of ‘five years of abuse’.

Daily Mail Australia has been told the Liberal Party’s investigation – which began eight months ago – is still ongoing and has been referred to external investigators.

Mr Martin remains in Parliament but is no longer in the Liberal party room while the matter is heard.

State Opposition Leader Mark Speakman previously said he would not speculate on the young MP’s future until that investigation was completed.

The 32-year-old MP still has photos from his wedding available on his private social media pages. It is clear that he did not inform his colleagues of the split.

“They only recently got married,” said a colleague, adding that they were “shocked” to hear the relationship was over.

Mr Martin has made his voice heard in Parliament in recent months.

At the end of November he campaigned for the introduction of ‘contact bans’ as an alternative to sustained violence orders.

Mr Martin publicly apologized for a series of text messages he sent Ms Wicks during that period, in which he called her a 'stupid s***' and a 'bloody pig', and promised to assist with any investigation into the accusations.

‘I believe the time has come to look at making an option available to people below the severity of an apprehended violence order. [AVO]’ he said at the time.

‘It is clear that there are people in our community who are no longer safe when an intimate relationship ends.

‘A less serious course of action than an AVO, a restraining order would be a first point of contact that people could easily use to serve as formal notice to the other party that the next step will be an AVO if they breach these rules. the contact ban.

‘I can tell you from experience that applying for an AVO is not an easy task. It is an extremely confrontational and triggering experience.’

When Martin gave his inaugural parliamentary speech in 2017, he spoke out against both bullying and domestic violence, explaining how his upbringing was shaped by his own experiences of being bullied on the playground.

“Domestic violence strikes a chord with virtually everyone in our state,” he said.

“As we see the number of reported incidents increase and more people taking a stand, I’m sure every family has at least one story to tell close to home.

“I know I do that among my friends and family. I will be an advocate among young men.

“We must ensure that young boys who will become young men receive the guidance necessary to teach and emphasize the value of respect in all relationships, even if – and especially if – it is not modeled at home.”

A man who ‘stole’ a speed camera sign on the side of a main road has divided the internet.

A passing motorist couldn’t believe his eyes when he saw the man removing the sign at Edgeworth in NSW’s Lake Macquarie region on Monday morning.

Lee Mitchell recalled how the man “threw it near the drain” when he later shared photos of it the bizarre incident Facebook.

The footage showed the man walking along a footpath carrying the sign that he had allegedly detached from the back of a telegraph pole.

At one point the man, who was wearing a black printed T-shirt and blue board shorts, pointed his middle finger at someone as traffic stopped on the busy road.

‘This man stole the speed camera signage this morning [and] threw it in the neighborhood,” Mr. Mitchell posted on a community Facebook page.

‘If you get a ticket for speeding during this period, there was no signage [and] was still missing [at] 10am that I noticed it’.

The post was divisive

Many praised the motorist for removing the sign.

‘Give this man a medal. F*****g legend,” one user said.

Others believed that the onus is on motorists to drive responsibly, regardless of whether a speed camera warning sign is posted or not.

“If you get a booking you’re breaking the law… very simple: don’t speed anywhere,” one person commented.

Another added: ‘Sorry but if you get booked it’s your own fault, you shouldn’t do that [sic] drove too fast in the first place.’

Some criticized the man for removing the sign and argued that more motorists will be caught speeding, not knowing there is a speed camera nearby.

‘Why remove the sign, isn’t it there to warn other motorists to slow down when a speed camera is approaching?’ one commented.

The NSW Government reintroduced portable speed camera warning signs last year.

The shockwave came three years after the government removed the signage following calls to scrap labels from mobile speed cameras.

“I have always said that I would rather people take it easy than receive a fine in the post two weeks after they committed the offence,” Prime Minister Chris Minns said at the time.

A spokesperson for Transport for NSW told Daily Mail Australia the signs advise motorists to slow down and are not intended to issue fines for speeding.

“The signs are in place when an enforcement session is underway, but motorists have a responsibility to ensure they drive within the speed limit at all times,” the spokesperson said.

‘The signage gives speed offenders every opportunity to change their behavior and helps to remind motorists to adhere to the limit.’

Drivers caught speeding, even if the speed camera warning sign is not clearly visible, will still have to pay a fine.

Beau Lamarre-Condon is said to have tried to hide the bodies in surf bags, under rocks and rubble

Det Supt Doherty said the bodies of Jesse Baird and Luke Davies were found on the fence line of a property in Bungonia.

They were hidden in surfboard pockets, under rubble and rubble.

“There’s a driveway that goes to a property and there’s a fence there, on the side of the driveway,” he said.

“There appears to have been an attempt to cover the bodies with stones and rubble.”

It is understood they had an on-again, off-again relationship before Baird started seeing Davies.

Luke Davies’ mother just wanted to know where her son was

Commissioner Webb said she was relieved the bodies of Luke Davies and Jesse Baird had been found.

“I’m very relieved for the families,” she said.

“I spoke to both families, they came off the highway and waited for news every day – every hour was an agonizing wait.”

She said Davis’ mother just wanted to know where he was.

“As a parent, and talking to Luke’s mom, I knew this is what parents want: they want to know where their kids are.”

Police spoke with Lamarre-Condon around 11 a.m. Tuesday, when he allegedly told them where the bodies were.

They were located two hours later, around 1 p.m.

Minutes later, police informed their families.

Beau Lamarre-Condon has been suspended without pay from the NSW Police Force

Accused killer Beau Lamarre-Condon has been suspended from the NSW Police Force without pay.

He is currently on remand in a prison in Silverwater, in Sydney’s west, and has helped police locate the bodies of his alleged victims after speaking to a lawyer.

Police have not yet confirmed how many bullets were fired from Lamarre-Condon’s police-issued firearm when Luke Davies and Jesse Baird were allegedly killed.

“We can confirm that a firearm was discharged and we will be able to get more answers today.

“We cannot determine how many bullets were actually fired from his firearm.”

Commissioner Webb said there will be an investigation into how the suspect could have committed two murders with his police rifle.

“That should never happen again,” she said.

‘We must look for ways to limit that risk as best as possible.’

She also said there will be an investigation into the police’s internal systems and access to firearms.

Woman who allegedly accompanied Lamarre-Condon is ‘innocent’

Det Supt Doherty said a female witness who allegedly accompanied Lamarre-Condon was innocent.

“What we will allege is that the suspect went to the first property in Bungonia as outlined and then returned to the property which was the first property searched and moved the bodies to the current location.”

When asked if the suspect had any connection to the Bungonia property, police said they were still trying to determine the connection.

“There doesn’t appear to be a connection but it will all unfold as the investigation takes place,” Detective Doherty said.

Commissioner Webb described the alleged killings as a “crime of passion” during a press conference on Monday.

She was criticized for describing an alleged domestic violence situation that way, and at Tuesday’s conference she said, “If that word upsets people, it wasn’t intended that way.”

“The motive for the crime is not a gay hate crime, but rather a domestic crime.

“It was intended to distinguish it from a gay hate crime.”

Hero cop has ‘barely eaten or slept’ since search began

Police officer leading the investigation, Detective Sergeant Sasha Pinazza, said: ‘I’m exhausted, I’ve barely eaten or slept.’

‘This morning we worked again and we achieved a wonderful result for the families.’

Detectives felt “deflated” when they failed to find the bodies yesterday, but said they were proud of the police’s efforts on Tuesday.

Det Supt Doherty would not reveal the condition the bodies were in when they were discovered on Tuesday, but did say “they were covered in rubble”.

Lamarre-Condon is said to have acted alone.

“We will allege that he acted alone and that he is the only person responsible for storing Luke and Jesse’s bodies at their current location,” he said.

Bodies were reportedly found in two surfboard bags

Chief Inspector Danny Doherty told a press conference that homicide crews had opened a new crime scene in Bungonia, about 20 minutes away from the original crime scene.

“Two surf bags were found,” he said.

“And some rubble and other interesting objects that are located there.

‘And at that stage it was declared a crime scene and the family were immediately informed of the development.’

He also said Lamarre-Condon revealed the whereabouts of the bodies after receiving legal advice.

It was the first time he cooperated with the police during the investigation

The accused killer helped police find the bodies of the Channel Ten presenter and his friend

NSW Police Commissioner Karen Webb confirmed at a press conference on Tuesday afternoon that two bodies had been located at a second crime scene in Bungonia.

The families of Jesse Baird and Luke Davies have been notified.

“We are confident that we have found Luke and Jesse,” she said.

‘Today, this afternoon, detectives from Strike Force Ashfordby located a second crime scene in Bungonia, a separate location they had searched yesterday and earlier.’

Commissioner Webb confirmed that the alleged killer, Beau Lamarre-Condon, helped police locate the bodies.

Human remains found in a building in Bungonia

Human remains have been found at a property in Bungonia, south of Sydney, during the hunt for the bodies of missing TV presenter Jesse Baird and his flight attendant friend Luke Davies.

Beau Lamarre-Condon, a senior officer in the NSW Police Force, is said to have shot the pair on Baird’s terrace in Paddington, on the outskirts of Sydney, last Monday.

Lamarre-Condon allegedly shot the pair with his Glock police pistol.

He turned himself in to police on Thursday and was charged with two counts of murder on Friday, but he refused to tell investigators where the bodies were.

Investigators had searched a remote property in Bungonia earlier this week, including several dams, but were unable to find the bodies.

on now deleted message from beau Lamarre-condon

The remains were discovered on Tuesday after police established a second crime scene at a different location in Bungonia.

Lamarre-Condon is said to have driven to the area in a rented van with an acquaintance last Wednesday and bought an angle screwdriver and padlock along the way.

He allegedly cut through a padlocked gate to access a private road and left the acquaintance for 30 minutes while he allegedly disposed of the bodies.

He then returned to Sydney, but police allege he bought weights at 11pm that evening before driving back to Bungonia, where they allege he then moved the bodies to a new location.

The van is believed to have left the Bungonia area around 4.30am on Thursday in a possible attempt to move the bodies to a new location, police said.

Sunrise presenter Nat Barr has confronted NSW Police Commissioner Karen Webb after an officer allegedly shot his ex-boyfriend and his new partner with his service pistol.

Beaumont Lamarre-Condon, 28, is behind bars after being charged with the murders of former Ten reporter Jesse Baird, 26, and Luke Davies, 29, in Sydney on February 19.

Investigators allege Lamarre-Condon’s crimes were the result of a months-long campaign of “predatory behavior,” which culminated in the fatal double shooting.

Webb was confronted about her lack of leadership during the week-long investigation by Barr and her cohost Matt Shirvington.

“You have been criticized for your lack of public presence on this issue. It wasn’t until three days later that I actually heard from you,” Shirvington said. ‘Why was that so?’

Webb responded, “It really was a live investigation. The officer reported himself on Friday. He has not been charged and will appear in court in the afternoon. I got up yesterday. I issued a statement on Sunday.

“I’ve been off doing other things, I have a big organization and a $5 billion budget for 22,000 people.

“The great thing about being a commissioner and a leader is that you have great people around you,” Webb continued.

‘I have a great director. I have a great team. And they all have a role to play. I let them do their job and they do it well.’

But Barr was unimpressed by her response.

‘Commissioner, it is about leadership. You said you’re the leader. And no matter how busy you are, you have a police officer who is allegedly involved in this.

“Do you have three days to speak for a crime that has gripped this nation, and especially this city? Come on.’

Webb hit back.

“It’s still a live investigation, it’s very complex.”

NSW Police Commissioner Karen Webb has been criticized for not speaking publicly about the killings of Mr Baird and Mr Davies until three days after the murder.

But Barr kept calling for Webb.

‘You don’t have to argue with anyone. To stand there and speak and be human, would it be a mistake not to do that?’ she continued.

Webb responded, “What I did on Sunday was talk to Jesse’s family. What I did yesterday was discussed with Luke’s family.

“I want them to know we’re doing everything we can to find Jesse and Luke.”

She was then asked if she deserves the criticism.

“There will always be haters. Haters love to hate. Isn’t that what Taylor says?’ she said.

‘I have work to do. It’s a big job. This is just one of many. We had seven murders last week. Although this is of course a complex matter. All we have to do now is find Jesse and Luke.”

Commissioner Webb, who earns a salary of $679,050, was criticized for remaining silent during a news conference Monday about the alleged double homicide.

Deputy Commissioner Dave Hudson answered questions about the investigation for more than 30 minutes, while Ms Webb spoke for just 12 minutes.

Many of the questions asked focused on the fact that the commissioner did not speak publicly about the case until three days after the alleged murders.

She said criticism of her leadership was “offensive” after she was accused of “absconding” by MP and former police officer Rod Roberts.

More to come.

The officer in the middle of a manhunt for two missing men has handed himself over to detectives and been arrested after Daily Mail Australia revealed his phone had been switched back on.

Officer Beau Lamarre-Condon, 28, was wanted for questioning by police after his ex-boyfriend, former Channel 10 presenter Jesse Baird, 26, and Baird’s new partner Luke Davies, 29, disappeared from Paddington, in Sydney’s east, on Monday evening .

Police are extremely concerned for the couple’s safety after a significant amount of blood was discovered at Baird’s Paddington mansion. Their belongings were dumped in a skip in Cronulla just after 11am on Wednesday.

Lamarre-Condon disappeared in the aftermath of the two men’s disappearance after telling his bosses he was going on sick leave and turning off his phone.

On Friday morning, Daily Mail Australia revealed that Lamarre-Condon’s phone showed signs of life after being turned off for hours.

Police revealed the officer reported to police at Bondi police station shortly after 10.30am on Friday.

A spokesperson added: ‘The man will be taken to Waverley Police Station where inquiries will continue.’

Police later confirmed to Daily Mail Australia that he had been arrested, but the hunt continues for a missing white van seen outside Mr Baird’s home.

Detectives have urged anyone who sees the white Toyota HiAce with NSW registration CW82PM to contact them immediately.

When Daily Mail Australia tried to contact Lamarre-Condon at 8am, the phone was switched off.

However, the phone was later turned back on and went off when called, with WhatsApp showing it was last active on the platform at 9.55am on Friday.

A further indication that his phone is in use: text messages sent last night were not received as iMessages. There were separate reports on Friday morning.

It comes as NSW Police launched a citywide search for a white van believed to be driving the celebrity hunter.

Police raided the Lamarre-Condon family home in Balmain late last night.

At the property in Balmain, in Sydney’s west, family members admitted they were “stressed” on Friday but declined to comment further.

A police officer has emerged as a person of interest in the disappearance of a former Channel Ten presenter and his partner after their bloodstained clothes were dumped in a skip and the TV star’s blood-splattered home 30km away was declared a crime scene.

The network’s former red carpet reporter Jesse Baird and his Qantas flight attendant boyfriend Luke Davies are missing from the TV producer’s Paddington terrace in Sydney’s east.

Mr Davies, 29, was with Mr Baird, 26, in Paddington on Monday but the pair then vanished and Mr Davies’ family have been unable to contact him.

It comes as police seized CCTV footage of the couple’s last known whereabouts on Monday night.

The men were captured wandering outside Mr Baird’s Paddington home before heading towards the back of the terrace. Neither have been seen since.

A manhunt was launched after a pile of the couple’s bloodied clothes was found in a large skip bin in the centre of Cronulla in Sydney’s south at around 11am on Wednesday.

Police then raced to Mr Baird’s $3million Federation terrace home in Paddington 30km away, where they found a ‘large amount of blood’ and bloodstained furniture.

Detectives are now investigating whether a third person could be involved after speaking with the families of the missing men on Thursday.

They have received information that a current NSW police officer once dated one of the men. That officer is yet to be located.

‘Following inquiries, detectives are looking at a line of inquiry that a third person may be able to assist with the investigation, a police statement read on Thursday night.

‘Police are currently trying to locate him.

‘Detectives will continue to look at all past relationships and associations.’

It was revealed on Thursday night that the AFL has been caught up in the men’s disappearance.

Mr Baird is also an AFL goal umpire who had been appointed to officiate a practice match between the Sydney Swans and Greater Western Sydney Giants game on Thursday.

The AFL confirmed that it contacted his family on Thursday after Mr Baird failed to show up to officiate the match.

Neighbours near Mr Baird’s rented Paddington home heard an argument early on Monday morning but that wasn’t reported to police until they began canvassing the scene two days later.

Police say they’re not excluding any lines of inquiry, however now hold grave fears for both men.

Detectives are said to be seeking Mr Baird and his partner after Mr Davies’ home in Waterloo in Sydney’s inner-south was also found to be empty.

Detective Superintendent Jodi Radmore, Commander of Eastern Suburbs PAC, begged either of the men to make contact but said police now fear for both of them.

When asked if a third person could have been involved in the men’s disappearances, she said that the ‘primary line of inquiry’ was finding the missing men.

‘There has been some sort of incident which has more than likely happened at the Paddington address and that has given us grave concerns for one, possibly both,’ she said.

‘It’s very early stages in the investigation. We are still processing the Paddington address. All lines of enquiry are open.’

She said neighbours had heard some shouting coming from the rented Paddington terrace early on Monday morning, but that was only reported to police on Wednesday.

‘Witnesses reported a verbal argument but it wasn’t reported to police at the time … it was only when police were canvassing that they mentioned it,’ Det Superintendent Radmore said.

Credit cards, wallets, a mobile phone and a $8000 watch had been found among the bloodied clothes in the skip in Cronulla.

Three cars belonging to the men have also been seized. Their bank accounts haven’t been touched since the weekend.

But Mr Baird’s bloodstained home has sparked serious concern for their fate, she said, admitting there was sufficient blood to believe at least one had suffered a ‘significant injury’.

Mr Baird was reported as being active online on Tuesday night.

Mr Davies last updated his social media five days ago with a series of photographs on Instagram of himself in the mountains around Vancouver in Canada.

Mr Davies grew up in Brisbane and recently moved to Sydney for work, according to friends.

Qantas flight attendant Maddison Bradley – Mr Davies’ best friend – said he was ‘dearly adored’.

‘I hope we find him. He is such a sweet soul!’ she told Daily Mail Australia.

‘We worked at Tigerair together and then he helped me get into Qantas.

‘He is an international flight attendant for Qantas and he is driven, humble and super intelligent.’

Friend Tomas Mian has known Mr Davies for ten years.

‘Luke has a lot of friends and is very fun social person. He is a kind and generous boy,’ he told news.com.au.

‘He seemed to love his new job. All of his Brisbane friends are in utter shock to only find this out today.’

Sophie Inez added: ‘I spoke to Luke just before he moved from Brisbane to Sydney with work a few months ago.’

‘He was so exited for his next chapter and flying long haul. He’s such a lovely and charismatic person.’

Other concerned friends took to Facebook to spread the word about the missing men.

I knew Luke back in my Brissy days and he recently moved to Sydney (Waterloo, but last seen in Paddington) for work. Please share this post and report any sightings or information, even if it seems insignificant,’ Anna Ghioni wrote.

On February 18, Mr Baird posted pictures of the pair together at Pink’s concert in Sydney two weeks ago.

After three years with Studio 10, Mr Baird left his producer/presenter role with the show in January when it was axed by the network late last year.

He had previously worked as a producer/presenter with Ten’s Totally Wild! show for four years as well as a seven-month stint hosting Gamify! for the network in 2019.

On Thursday, Totally Wild’s Ranger Stacey Thompson said she was stunned.

‘I’m shocked actually,’ she told Daily Mail Australia. ‘I worked with Jesse for a few years and we sat across from one another in the TW office.

‘He was a lovely work friend, always professional and keen to learn. I prefer not to comment further at this time, until more details come to light.’

A pensioner who was fined for using a mobile phone while driving has claimed he has never had one in his life – and was actually holding his wallet.

Frank Singh, 77, was fined $362 after he was caught by a mobile phone detection camera on the Pacific Motorway in the Northern Rivers region of NSW last September.

Mr Singh refused to pay the fine, arguing that he could not use a telephone at the time because he had never owned one – or even a computer.

The 77-year-old decided to appeal and take Revenue NSW to court, despite the risk of having to pay thousands in legal fees if he lost the case.

Frank Singh, 77, was fined $362 after he was captured by phone detection cameras driving on the Pacific Motorway in the Northern Rivers region of NSW on September 19.

“It looks like I'm guilty of it, but I'm not,” he said A current issue.

“I thought, what the hell is this about, I don't have a cell phone. I've never used a cell phone before. What a load of shit.”

Mr Singh was pinged for apparently using a phone while driving on a road trip to visit a partner.

Footage captured by the traffic detection cameras shows Mr Singh sitting behind the wheel and looking at an object in his left hand.

“I think it could be my wallet,” he said when asked what the item could be.

Although Mr Singh admitted he cannot remember exactly what he was doing at the time, he believes he may have put his wallet on the passenger seat after paying for the fuel.

He decided to appeal the fine, which required a friend to provide her mobile phone and email address.

The review was rejected and Mr Singh was again ordered to pay the fine.

“I thought it would be a pretty simple process to drop it,” his friend Kishori Breeze told the program.

'He received a letter saying: yes, we understand that you say you don't have a phone, but please pay the fine anyway.'

But Mr Singh refused to give up.

“Then I thought, I'm not guilty, I don't have a damn phone,” he said.

The pensioner was warned by the Byron Bay magistrate that if found guilty he would not only have to pay the $362 fine but also at least $2,000 in legal costs.

Lawyer Richard Mitri said Mr Singh would have suffered a “pretty big blow” if he had lost the second appeal.

He said traffic violations typically presumed drivers had done something wrong, making it difficult to prove otherwise in court.

Although Mr Singh (pictured) cannot remember exactly what he was doing at the time, he says it is possible he put his wallet on the passenger seat after paying for fuel.

Although Mr Singh (pictured) cannot remember exactly what he was doing at the time, he says it is possible he put his wallet on the passenger seat after paying for fuel.

“With most traffic violations it's actually the other way around,” says Mitry.

“So in this case, you're under the assumption that you did the wrong thing based on the fact that a camera captured you and the camera thought you did the wrong thing.”

In an unexpected turn of events, Revenue NSW has since withdrawn the fine.

Mr Singh received a letter stating that he would not appear in court following an investigation by the government agency.

“We have decided to withdraw the fine,” the letter said.

“You little bloody beauty, how good is that,” said Mr. Singh when he heard the news.

He planned to celebrate the victory with a beer at his local pub.
