New Delhi: The Prime Minister of Delhi, Arvind Kejriwal has been called by the Enforcement Directorate (ED) for the third time in the past two months. After refusing to appear before the agency twice, party chief Arvind Kejriwal has denied the honor, according to the Aam Aadmi Party (AAP). Delhi CM rejects third ED appeal, what next?

As mentioned earlier, the Delhi Chief Minister, who was to be summoned before the Enforcement Directorate (ED) today, has rejected the agency’s third and final appeal. According to AAP, the party chief is willing to cooperate with ED but refuses to appear before them as requested in the ED summons. According to the party: “Ready to cooperate with ED investigation, but agency notice is illegal. Their intention is to arrest Arvind Kejriwal. They want to stop him from the election campaign.” Now that the leader has refused to comply with ED’s third summons, no more summons will be sent to him. Instead, the agency can now issue a non-bailable court order against him.

As per the provisions of the Prevention of Money Laundering Act (PMLA) Rules, a person can skip an ED summons only three times. If he/she ignores the summons three times, ED has the power and ability to apply for a non-bailable warrant (NBW) from the court, forcing the person to appear in court on a specified date and time . If the person still resists and does not appear in court, he may be arrested and then brought to justice.

Kejriwal was summoned by the ED on December 21 in connection with the Delhi excise policy case. However, he was not present at the summons issued by the Enforcement Directorate, the investigating agency. Before this, the Delhi CM was asked to appear before ED on November 2, 2023.

AAP leader Raghav Chadha had claimed that the summons in question was not issued by the concerned agency but rather by the BJP. He alleged that the BJP was responsible for drafting and sending these summons. “We believe that this subpoena was not sent by the agency; this summons is sent by the BJP. This summons is prepared and sent by the BJP itself; the whole issue is not legal; it is political; it is inspired by politics,” the AAP minister said in the report.
