Before we go further, let’s know what is CAA? The bill proposed to amend the Citizenship Act, 1955 and aimed to make foreign illegal migrants of certain religious communities from Afghanistan, Bangladesh and Pakistan eligible for Indian citizenship.
Before the new rules were introduced, citizenship in India was regulated by the Citizenship Act of 1955. The bill specifies that citizenship in India can be acquired based on five criteria: by birth in India, by descent, by registration, by naturalization , such as extended stay. in India, and by the incorporation of territory into India.
The amendments on citizenship for illegal migrants will not apply in certain areas. These include the tribal areas of Assam, Meghalaya, Mizoram and Tripura as included in the Sixth Schedule of the Constitution. The exceptions also include the states covered by the “Inner Line” license under the Bengal Eastern Frontier Regulations 1873.
In his post on X, Shah shared details about the government’s notification of the Citizenship Act. The notification includes forms on which those seeking Indian citizenship must fill details including name, name of parents and spouse, date of entry into India, occupation and to which minority community they belong.
Applicants must also provide details of the family members residing with them in India. They must also include any details of the criminal proceedings.
In addition, applicants must complete an oath of allegiance to the Indian Constitution. They must, among other things, submit a copy of a valid or expired foreign passport and a copy of a valid or expired residence permit.
“Proof of the parents’ date of birth, viz. a copy of the passport or birth certificate. In case of non-availability of passport of mother/father, birth certificate of the applicant clearly mentioning name, address and nationality of mother/father,” the notification said.
One of the key objectives of the CAA is to provide an expedited route to Indian citizenship for persecuted minorities from neighboring countries. These communities, such as Hindus, Sikhs, Christians, Buddhists, Jains and Parsis, who face religious persecution in Afghanistan, Pakistan and Bangladesh, may find refuge in India.
The CAA is also seen as a humanitarian effort, providing a legal framework for those seeking asylum due to religious persecution. By addressing these issues, the law aims to maintain India’s long tradition of providing shelter to those in need.
The CAA seeks to address the status of people who have been living in India for an extended period of time but do not have proper citizenship documentation. By providing a streamlined process for eligible individuals, the law aims to reduce the number of stateless people.
Now it is essential to recognize that the CAA has faced criticism and concerns from several quarters. Critics argue that it could exclude certain groups and challenge the secular fabric of the nation. It is crucial to have a balanced perspective on this issue.
