The court ordered the KVS to grant access, quashing the authorities’ notice denying access. The petitioner, originally from Azamgarh in Uttar Pradesh, moved to Delhi for work and sought admission for his son in Class 1. The court ordered admission in Class 3 due to the time lost during the trials.
New Delhi: The Delhi High Court has ruled that the Centre, which controls the Kendriya Vidyalaya Sangathan (KVS), is the competent authority for announcing the annual income threshold for determining the eligibility of a child under the Economically Weaker Sections (EWS) category. It clarified that KVS cannot deny admission on the basis of an EWS certificate obtained from a state other than the Delhi government.
Justice Anup Jairam Bhambhani said that the central government has notified the gross annual household income threshold for the EWS category as less than Rs 8 lakh as the court held that the denial of admission on the ground that the EWS certificate comes from is from Uttar Pradesh and not Delhi. untenable.
The order came in response to a petition by a man seeking admission for his son in a Kendriya Vidyalaya in Delhi under the EWS category.
While alleging additional irregularities in the petition, the court granted the relief sought and directed the KVS to grant regular admission to the petitioner’s unit at Kendriya Vidyalaya, Narela, for the academic session 2023-2024 in Class 3.
