A Texas man who fatally shot his wife on camera after discovering she was having an affair has been sentenced to just 10 years behind bars for her murder.

Carey Birmingham, 60, was convicted earlier this week after he shot and killed his wife Patricia, 48, in December 2021 after discovering she was having an affair.

The murder was captured on video and despite the overwhelming evidence, Birmingham will serve 10 years in prison, with a maximum of 20 years.

In the disturbing video, Birmingham can be seen driving in the driveway of their home in Spring, Texas, wearing a bathrobe and holding a shotgun.

Birmingham can be heard saying to his wife: “Okay, see you later. You are [going to] meet Jesus, I hope it was worth it,” before shooting her three times.

The shooting happened while their daughter Olivia was at school, with the couple having a 30-minute argument before the shooting.

Audio obtained by ABC13 contains several minutes of conversation between the two, which became a large part of the defense of Birmingham’s crime of passion.

You hear him say: ‘I’m done.’, while Patricia shoots back: ‘I’m done too’, making their conversation more and more heated.

Birmingham attorney Anthony Osso said they pleaded guilty to the all-female jury to convince jurors that he shot Patricia in the heat of the moment.

Osso told the newspaper: “We never tried to justify our client’s actions, but the defense was not about justification. It was about why he did what he did.”

Birmingham will serve 10 years in prison for the death and will be released on parole after five years.

Daughter Olivia told the newspaper about her father’s conviction: ‘I lost both my parents that day.

“My father also died that day because the person who did that to my mother and my father is not the same person.”

She added, “I don’t know, sudden passion? You must have something. You must have been making that decision within yourself for a while; I feel like doing something, to do it with someone you really love.’

Olivia had addressed her father in court, telling him, “No matter what was said in this trial, you know what kind of woman she was, and you know what you did and how he took my favorite person in this world. ‘

Olivia also testified that she never witnessed her father physically abuse her mother.

She told ABC that she wanted to raise awareness about different types of abuse, and that she would never forgive her father for what he did.

In a post on social media, Patricia’s sister Mary Dees said: ‘My sister was strong and would not back down or show fear towards this man.

“The prosecutors did an excellent job and were equally shocked by the verdict. I think the judge was even shocked.

‘There has been NO justice done here. My sister didn’t deserve this. Casey Birmingham is not the victim.”
