EVIL Josef Fritzl was pictured grinning today as he dramatically won his bid to be transferred to a regular prison – paving the way for his future release after 15 years behind bars.

Fritzl, 88, told A court in Austria today he deeply regretted that he had locked his daughter Elisabeth in an underground cellar and that he had tackled the crimes “intensely”.

He is said to have struggled to hear the judges deliver their verdict, which will see Fritzl moved from Stein's high-security wing. jail to a traditional grand piano.

They ordered him to continue regular therapy sessions, which are said to have helped “rehabilitate” the rapist and murderer, said his lawyer, Dr. Astrid Wagner.

Fritzl was sentenced to life in prison in 2009 after he locked his daughter Elisabeth in the basement of his house in Amstetten for 24 years and fathered seven children with her.

But he could be released to perform the service remainder of his sentence in a nursing home after developing Dementia.

The court in Krems an der Donau heard today that he had regularly read the files about his prosecution in 2009.

The result means that Fritzl can now submit a new application for his release to a care home within a year.

The hearing took place in a courtroom instead of a jail office, where early release requests are generally processed.

Chief Justice Ferdinand Schuster told The Sun: “This case was heard in court because it is of great importance to the media and the public.

“The suspect said he intended to submit a new application.

“It's impossible to predict future but perhaps another application can be submitted within a year.”

The sample was depicted when it arrived at the district court of the Landesgericht in a Police van at 7.20 am, accompanied by four Police officers.

It comes after he was seen visiting local cafes near his prison in Krems an der Donau, just weeks before his release.

His lawyer, Dr Astrid Wagner, told The Sun before the hearing: “We intend to release him from the prison he is currently in.

“He is in a dangerous prison and we need to have him transferred to a normal prison so he can be released into a nursing home.

“We have a new psychiatric report that says he is not a danger to anyone.

“He's having a little trouble with the Dementiabut only a little.

“There was a report that he was drinking coffee, but this is not true – because the first thing he would do when released is drink an Austrian beer.

“He wants to continue with the process – and he has a lot of confidence in it.

“He says it's in God's hands, but it's also in my hands.”

Ms Wagner added: “He expects today's hearing to have a positive outcome, but not that he can go home today.

“A new application must be submitted for this.

“This will happen soon because I am convinced that he has dealt with his actions very intensively – such as completing therapies and so on – and that he also deeply regrets them.”

At his 2009 trial, Fritzl pleaded guilty to rape, false imprisonment, negligent homicide and incest.

The sick monster will be eligible for parole in March this year Austria's mild criminal laws.

According to local law, prisoners ready for parole can be released depending on their behavior and their mental and physical condition.

DAUGHTER'S NIGHTMARE

Fritzl kept his daughter Elisabeth captive in a newly built cellar complex for 24 years since 1984.

The evil father drugged and abused his daughter, raped her more than 3,000 times and fathered seven children with her.

The heartless monster did not hesitate to throw the bodies of the children who died at birth into a furnace.

Three of the children were raised in the cellar by their mother, while another three were raised by the ill Fritzl and his wife Rosemarie.

Fritzl had convinced his wife that their daughter had run away to join a cult.

In a cruel twist, he forced Elisabeth to write letters to Rosemaryclaiming that she could not take care of the children, and asked her to raise them.

It was only when Elisabeth's eldest daughter, Kerstin, became seriously ill in 2008 that her ordeal came to an end.

In a rare act of mercy, Fritzl allowed Elisabeth to take the 19-year-old to the hospital.

She managed to talk to the police and revealed the horrors she had suffered over the years.

Her first words were, “No one will believe me.”

Elisabeth's eleven-hour recorded testimony led to Fritzl's sentencing to life imprisonment.

Elisabeth and her children now live under adopted names after years of therapy, while Rosemarie, now 84, lives in a small flat in Linz, about 30 miles from the former Fritzl home.

Meanwhile, Fritzl is physical and mental health has worsened.

In an exclusive interview with The Sun last year through his lawyer, Fritzl claimed he would one day see his family again.

He also said he wanted to live to be 130 and was confident he could do that if he drank enough water.

The twisted father asks his daughter Elisabeth to help him install a door in his basement in 1984.

She agreed and moments later she is drugged with an ether-soaked towel, tied up and chained to a bed.

She would spend the next 24 years in the hellish prison of Amstetten.

The evil Fritzl then raped her more than 3,000 times in a rat-infested bunker.

He hit and kicked her and forced her to perform humiliating acts, including reenacting scenes from violent pornographic films.

Elisabeth gave birth to seven babies in the basement without medical care.

Kerstin, born in 1988, Stefan (1990) and Felix (2002) were left behind with their mother in the underground hellhole.

But Lisa, (born 1992), Monica (1994) and Alexander (1996) – were raised upstairs by Fritzl and his wife Rosemarie after he convinced her that Elisabeth had left them on their doorstep.

Alexander's twin brother Michael died shortly after birth as the cruel Fritzl threw his body into an incinerator.

In the family's nightmare, Fritzl is threatened if they dare to escape and is punished by turning off the electricity.

Their nightmare came to an end when Kerstin became seriously ill in 2008.

Fritzl allowed Elisabeth to take her to the hospital, where she revealed the shocking horrors she had suffered.

Despite trying to argue, Fritzl tried to be a protective father was sentenced to life in prison in 2009.
